Stat. tit. 36, § 36-110","heading":"Application as to particular types of insurers","body":"No provision of the Oklahoma Insurance Code, Section 101 et seq.\n\nof this title, shall apply to:\n\n1. Nonprofit hospital service and medical indemnity\n\ncorporations, except as stated in Sections 601 et seq. and 2601 et\n\nseq. of this title;\n\n2. Fraternal benefit societies, except as stated in Section\n\n2701.1 et seq. of this title;\n\n3. Farmers' mutual fire insurance associations, except as\n\nstated in Section 2801 et seq. of this title;\n\n4. Mutual benefit associations, except as stated in Section\n\n2401 et seq. of this title;\n\n5. Domestic burial associations;\n\n6. Any domestic association organized subject to the\n\nsupervision or by the authority of any incorporated Grange Order of\n\nPatrons of Husbandry, when the association is formed exclusively for\n\nthe mutual benefit of the members of such order. Effective January\n\n1, 1982, The Oklahoma State Union of the Farmers' Educational and\n\nCooperative Union of America shall comply with all provisions of the\n\nOklahoma Insurance Code;\n\n7. Trust companies organized pursuant to the provisions of\n\nTitle 6 of the Oklahoma Statutes except that the title insurance and\n\nsurety insurance business of such trust companies shall be subject\n\nto the Oklahoma Insurance Code;\n\n8. Soliciting agents of mutual insurance corporations or\n\nassociations, operating only in this state, that issue no stock or\n\nother form of security, do not operate for profit, and have none of\n\ntheir funds inure to the benefit of individuals except in the form\n\nof less expensive insurance and necessary expenses of operation, if\n\nprovisions are made in the bylaws of the insurer for the election of\n\nany soliciting agents by a majority of the policyholders in the area\n\nwhere the soliciting agent solicits insurance;\n\n9. The Mutual Aid Association of the Church of the Brethren or\n\nthe Mutual Aid Association of the Mennonite and Brethren in Christ;\n\n10. Incorporated or unincorporated banking associations having\n\nbeen in existence for over fifteen (15) years and consisting of more\n\nthan seventy-five (75) member banks within this state for issuance\n\nof blanket fidelity bonds for banks within this state for each\n\nbank's own use, or any nonprofit trust sponsored by such\n\nassociations' member banks providing employee benefits such as life,\n\nhealth, accident, disability, pension and retirement benefits for\n\nbanks, bank holding companies and subsidiaries thereof, the\n\nassociations' employees and associate members;\n\n11. A religious organization, or members of the organization,\n\nif the organization:\n\na. is a nonprofit religious organization,\n\nb. is limited to participants who are members of the same\n\nreligion,\n\nc. acts as an organizational clearinghouse for\n\ninformation between participants who have financial,\n\nphysical or medical needs and participants with the\n\npresent ability to pay for the benefit of those\n\nparticipants with present financial or medical needs.\n\nNothing in this subparagraph shall prevent the\n\norganization from establishing qualifications of\n\nparticipation relating to the health of the\n\nprospective participant, nor shall it prevent the\n\nparticipants from limiting the financial or medical\n\nneeds that may be eligible for payment among the\n\nparticipants,\n\nd. provides for the financial or medical needs of a\n\nparticipant through payments directly from one\n\nparticipant to another, and\n\ne. suggests amounts that participants may voluntarily\n\ngive with no assumption of risk or promise to pay\n\neither among the participants or between the\n\nparticipants and the organization. Nothing in this\n\nsubparagraph shall prevent the organization from\n\ncancelling the membership of a participant if the\n\nparticipant indicates unwillingness to participate by\n\nfailing to make a payment to another participant for a\n\nperiod in excess of sixty (60) days; or\n\n12. Charitable organizations that:\n\na. are described in Section 501(c)(3) of the Internal\nin this\n\nsubparagraph shall prevent the organization from\n\ncancelling the membership of a participant if the\n\nparticipant indicates unwillingness to participate by\n\nfailing to make a payment to another participant for a\n\nperiod in excess of sixty (60) days; or\n\n12. Charitable organizations that:\n\na. are described in Section 501(c)(3) of the Internal\n\nRevenue Code and Section 170(c) of the Internal\n\nRevenue Code,\n\nb. issue qualified charitable gift annuity contracts,\n\nc. have a minimum of One Hundred Thousand Dollars\n\n($100,000.00) in unrestricted assets that are\n\nexclusive of the assets comprising its qualified\n\ncharitable gift annuities, and\n\nd. have been in continuous operation for at least three\n\n(3) years or are successors or affiliates of a\n\ncharitable organization that has been in continuous\n\noperation for at least three (3) years,\n\nexcept as stated in the Oklahoma Charitable Gift Annuity Act.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8ae7cf4e8729433f73abe28d80b2ac9aaf6d224a2e92329a060945c70896c849","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-109","next":"us-ok/okla.-stat.-tit.-36-36-1100"},"notice":"GroundRules: Original legal text.
