Stat. tit. 36, § 36-1100.1","heading":"Definitions","body":"As used in the Unauthorized Insurers and Surplus Lines Insurance\n\nAct:\n\n1. \"Admitted insurer\" means, with respect to a state, an\n\ninsurer that is licensed to transact the business of insurance in\n\nsuch state;\n\n2. \"Home state\" means:\n\na. except as provided in subparagraphs b through e of\n\nthis paragraph, with respect to an insured:\n\n(1) the state in which an insured maintains its\n\nprincipal place of business or, in the case of an\n\nindividual, the individual's principal residence,\n\nor\n\n(2) if one hundred percent (100%) of the insured risk\n\nis located out of the state referred to in\n\ndivision (1) of this subparagraph, the state to\n\nwhich the greatest percentage of the insured's\n\ntaxable premium for the insurance contract is\n\nallocated,\n\nb. with respect to determining the home state of the\n\ninsured, \"principal place of business\" means:\n\n(1) the state where the insured maintains its\n\nheadquarters and where the insured's high-level\n\nofficers direct, control and coordinate the\n\nbusiness activities, or\n\n(2) if the insured maintains its headquarters or the\n\ninsured's high-level officers direct, control and\n\ncoordinate the business activities outside\n\nOklahoma, the state to which the greatest\n\npercentage of the insured's taxable premium for\n\nthat insurance contract is allocated,\n\nc. with respect to determining the home state of the\n\ninsured, \"principal residence\" means:\n\n(1) the state where the insured resides for the\n\ngreatest number of days during the calendar year,\n\nor\n\n(2) if the insured's principal residence is located\n\noutside any state, the state to which the\n\ngreatest percentage of the insured's taxable\n\npremium for that insurance is allocated,\n\nd. if more than one insured from an affiliated group are\n\nnamed insureds on a single nonadmitted insurance\n\ncontract, the term \"home state\" means the home state,\n\nas determined pursuant to division (1) of subparagraph\n\na of this paragraph, of the member affiliated group\n\nthat has the largest percentage of premium attributed\n\nto it under such insurance contract, or\n\ne. when the group policyholder pays one hundred percent\n\n(100%) of the premium from its own funds, the term\n\n\"home state\" means the home state, as determined\n\npursuant to division (1) of subparagraph a of this\n\nparagraph, of the group policyholder. When the group\n\npolicyholder does not pay one hundred percent (100%)\n\nof the premium from its own funds, the term \"home\n\nstate\" means the home state, as determined pursuant to\n\ndivision (1) of subparagraph a of this paragraph, or\n\nof the group member;\n\n3. \"Independently procured insurance\" means insurance procured\n\nby an insured directly from a nonadmitted insurer;\n\n4. \"Licensed\" means, with respect to an insurer, authorization\n\nto transact the business of insurance in a state by a license,\n\ncertificate of authority, charter or otherwise;\n\n5. \"Multistate risk\" means a risk covered by a nonadmitted\n\ninsurer with insured exposures in more than one state;\n\n6. \"Nonadmitted insurance\" means any property and casualty\n\ninsurance permitted in a state to be placed directly through a\n\nsurplus lines licensee or broker with a nonadmitted insurer eligible\n\nto accept such insurance. For purposes of the Unauthorized Insurers\n\nand Surplus Lines Insurance Act, nonadmitted insurance includes\n\nindependently procured insurance and surplus lines insurance;\n\n7. \"Nonadmitted insurer\" means, with respect to a state, an\n\ninsurer not licensed to engage in the business of insurance in such\n\nstate, but shall not include a risk retention group as that term is\n\ndefined under applicable federal law;\n\n8. \"Single-state risk\" means a risk insured with insured\n\nexposures in only one state;\n\n9. \"Surplus lines insurance\" means insurance procured by a\n\nnonadmitted licensee or broker from a surplus lines insurer as\n\npermitted under the law of the insured's home state; and\n\nde a risk retention group as that term is\n\ndefined under applicable federal law;\n\n8. \"Single-state risk\" means a risk insured with insured\n\nexposures in only one state;\n\n9. \"Surplus lines insurance\" means insurance procured by a\n\nnonadmitted licensee or broker from a surplus lines insurer as\n\npermitted under the law of the insured's home state; and\n\n10. \"Surplus lines licensee\" or \"surplus lines broker\" means an\n\nindividual, firm or corporation that is licensed in the insured's\n\nhome state to sell, solicit, or negotiate insurance, including the\n\nagent of record on a nonadmitted insurance policy, on properties,\n\nrisks or exposures located or to be performed in a state allowing\n\nnonadmitted insurers to do business.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6721e3be5170730edc4076d895674538be1ee6c1e427c1f33c7f06e0e29f3f13","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1100","next":"us-ok/okla.-stat.-tit.-36-36-1100.2"},"notice":"GroundRules: Original legal text.
