No person in Oklahoma shall in any manner:\n\n1. Represent or assist any nonadmitted insurer in the\n\nsoliciting, procuring, placing, or maintenance of any nonadmitted\n\ninsurance coverage upon or with relation to any subject of insurance\n\nresident, located, or to be performed in Oklahoma without being a\n\nsurplus lines licensee or broker as defined in the Unauthorized\n\nInsurers and Surplus Lines Insurance Act; or\n\n2. Inspect or examine any risk or collect or receive any\n\npremium on behalf of any nonadmitted insurer without being a surplus\n\nlines broker or licensee as defined in the Unauthorized Insurers and\n\nSurplus Lines Insurance Act.\n\nB. Any person transacting insurance or acting as a surplus\n\nlines broker or licensee in violation of this section shall be\n\nliable to the insured for the performance of any contract between\n\nthe insured and the insurer resulting from the transaction.\n\nC. This section shall not apply as to reinsurance, to surplus\n\nline insurance lawfully procured pursuant to the Unauthorized\n\nInsurers and Surplus Lines Insurance Act, to transactions exempt\n\nunder Section 606 of this title (Authorization of Insurers and\n\nGeneral Qualifications), or to professional services of an adjuster\n\nor attorney-at-law from time to time with respect to claims under\n\npolicies lawfully solicited, issued, and delivered outside of\n\nOklahoma.\n\nD. The investigation and adjustment of any claim in this state\n\narising under an insurance contract issued by a nonadmitted insurer\n\nshall not be deemed to constitute the transacting of the business of\n\ninsurance in this state.\n\nE.
