Every surplus lines insurer issuing or delivering a surplus\n\nline policy through a surplus lines licensee or broker in this state\n\nshall conclusively be deemed thereby to have irrevocably appointed\n\nthe Insurance Commissioner as its attorney for acceptance of service\n\nof all legal process, other than a subpoena, issued in this state in\n\nany action or proceeding under or arising out of the policy, and\n\nservice of process upon the Insurance Commissioner shall be lawful\n\npersonal service upon the surplus lines or nonadmitted insurer.\n\nB. Each surplus line policy shall contain a provision stating\n\nthe substance of subsection A of this section, and designating the\n\nperson to whom the Insurance Commissioner shall mail process as\n\nprovided in subsection C of this section.\n\nC. Triplicate copies of legal process against such an insurer\n\nshall be served upon the Insurance Commissioner, and at time of\n\nservice the plaintiff shall pay to the Insurance Commissioner Twenty\n\nDollars ($20.00), taxable as costs in the action. The Insurance\n\nCommissioner shall immediately mail one copy of the process so\n\nserved to the person designated by the insurer in the policy for the\n\npurpose, by mail with return receipt requested.
