Every property and casualty insurance company doing business\n\nin this state, unless otherwise exempted by the domiciliary\n\ncommissioner, shall annually submit the opinion of an appointed\n\nactuary entitled “Statement of Actuarial Opinion”. This opinion\n\nshall be filed in accordance with the appropriate NAIC Property and\n\nCasualty Annual Statement Instructions.\n\nB. 1. Every property and casualty insurance company domiciled\n\nin this state that is required to submit a Statement of Actuarial\n\nOpinion shall annually submit an actuarial opinion summary written\n\nby the company’s appointed actuary. This actuarial opinion summary\n\nshall be filed in accordance with the appropriate NAIC Property and\n\nCasualty Annual Statement Instructions and shall be considered as a\n\ndocument supporting the actuarial opinion required in subsection A\n\nof this section.\n\n2. A company licensed but not domiciled in this state shall\n\nprovide the actuarial opinion summary upon request.\n\nC. 1. An actuarial report and underlying workpapers as\n\nrequired by the appropriate NAIC Property and Casualty Annual\n\nStatement Instructions shall be prepared to support each actuarial\n\nopinion.\n\n2. If the insurance company fails to provide a supporting\n\nactuarial report and/or workpapers at the request of the Insurance\n\nCommissioner or the Commissioner determines that the supporting\n\nactuarial report or workpapers provided by the insurance company are\n\notherwise unacceptable to the Commissioner, the Commissioner may\n\nengage a qualified actuary at the expense of the company to review\n\nthe opinion and the basis for the opinion and prepare the supporting\n\nactuarial report or workpapers.\n\nD.
