The Insurance Commissioner shall promulgate rules and\n\nstatistical plans adapted to each of the rating systems on file,\n\nwhich may be modified, from time to time, and which shall be used\n\nthereafter by each insurer in the recording and reporting of its\n\nloss and countrywide expense experience, in order that the\n\nexperience of all insurers may be made available, at least annually,\n\nin such form and detail as may be necessary to aid it in determining\n\nwhether rating systems comply with the standards set forth in this\n\nact.\n\n1. Such rules and plans may also provide for the recording and\n\nreporting of expense experience items which are specially applicable\n\nto this state and are not susceptible to determination by a\n\nprorating of countrywide expense experience.\n\n2. In promulgating such rules and plans, the Commissioner shall\n\ngive due consideration to the rating system on file and, in order\n\nthat such rules and plans may be as uniform as is practicable among\n\nthe several states, to the rules and to the form of the plans used\n\nfor such rating systems in other states.\n\n3. No insurer shall be required to record or report its loss\n\nexperience on a classification basis that is inconsistent with the\n\nrating system filed by it.\n\n4. The Commissioner may designate one or more advisory\n\norganizations or other agencies to assist it in gathering such\n\nexperience and making compilations thereof, and such compilations\n\nshall be made available, subject to reasonable rules promulgated by\n\nthe Commissioner, to insurers and advisory organizations.\n\nB. Reasonable rules and plans may be promulgated by the\n\nCommissioner for the interchange of data necessary for the\n\napplication of rating plans.\n\nC. In order to further uniform administration of rate\n\nregulatory laws, the Commissioner and every insurer and advisory\n\norganization may exchange information and experience data with\n\ninsurance supervisory officials, insurers and rating organizations\n\nin other states and may consult with them with respect to ratemaking\n\nand the application of rating systems.\n\nD.
