If the Insurance Commissioner determines, based on an\n\ninvestigation of complaints of unfair claim settlement practices,\n\nthat an insurer has engaged in unfair claim settlement practices\n\nwith such frequency as to indicate a general business practice and\n\nthat such insurer should be subjected to closer supervision with\n\nrespect to such practices, the Commissioner may require the insurer\n\nto file a report at such periodic intervals as the Commissioner\n\ndeems necessary. The Commissioner shall also devise a statistical\n\nplan for such periodic reports, which shall contain but not be\n\nlimited to the following information:\n\n1. The total number of written claims filed, including the\n\noriginal amount filed for by the insured and the classification by\n\nline of insurance of each individual written claim, for the past\n\ntwelve-month period or from the date of the insurer's last periodic\n\nreport, whichever time is shorter;\n\n2. The total number of written claims denied, for the past\n\ntwelve-month period or from the date of the insurer's last periodic\n\nreport, whichever time is shorter;\n\n3. The total number of written claims settled, including the\n\noriginal amount filed for by the insured, the settled amount, and\n\nthe classification of line of insurance of each individual settled\n\nclaim, for the past twelve-month period or from the date of the\n\ninsurer's last periodic report, whichever time is shorter;\n\n4. The total number of written claims for which lawsuits were\n\ninstituted against the insurer, including the original amount of the\n\nclaim filed for by the insured, the amount of final adjudication,\n\nthe reason for the lawsuit and the classification by line of\n\ninsurance of each individual written claim, for the past twelve-\n\nmonth period or from the date of the insurer's last periodic report,\n\nwhichever time is shorter; and\n\n5. All information required by paragraph 14 of Section 1250.5\n\nof this title.\n\nB.
