The maximum daily storage rate allowed to be charged by an\n\nauto body repair shop and mandatory reimbursement rates for insurers\n\nfor a motor vehicle total loss for each calendar day, for the first\n\nten (10) calendar days the vehicle is in the possession of the shop,\n\nshall be Thirty-nine Dollars ($39.00) for all motor vehicles of any\n\nsize, including marine vessels, and One Hundred Twenty-five Dollars\n\n($125.00) for vehicles with lithium-ion batteries that have\n\nsustained damage to the battery pack or have exhibited fire, smoke,\n\nor popping or hissing sounds, if the vehicle is stored pursuant to\n\nthe original equipment manufacturer requirements.\n\nB. On the eleventh calendar day, the maximum daily storage rate\n\nmay increase to Seventy-five Dollars ($75.00) per calendar day for\n\nall motor vehicles of any size, include marine vessels, and to Two\n\nHundred Dollars ($200.00) per calendar day for vehicles with\n\nlithium-ion batteries that have sustained damage to the battery pack\n\nor have exhibited fire, smoke, or popping or hissing sounds, if the\n\nvehicle is stored pursuant to the original equipment manufacturer\n\nrequirements, if the estimate or supplement on total loss vehicles\n\nis not approved by the insurance company within the first seven (7)\n\ndays and the auto body repair shop has a written record showing the\n\ndate, time, and type of communication made to the insurance company\n\nrequesting such supplementals. Requests for supplementals to\n\ndetermine a total loss shall be made before the tenth day following\n\nthe request.\n\nC. The provisions of subsections A and B of this section shall\n\nnot apply to vehicles in which the damage to the vehicle\n\nnecessitates indoor storage and the insurance company has approved\n\nindoor storage of the vehicle in advance at an agreed rate.\n\nD. Each auto body repair shop shall provide written invoices\n\nand respond to requests for invoices concerning the pickup, release,\n\nor delivery of a motor vehicle on its premises to the insurance\n\ncompany within eight (8) business hours.\n\nE. The maximum daily storage rate set forth in this section\n\nshall apply to direct repair programs.\n\nF. The maximum daily storage rate may be increased upon\n\napproval by the Oklahoma Insurance Department based on current\n\nmarket conditions. Adjustments to the maximum daily storage rate\n\nshall be made annually based on bulletins issued by the Oklahoma\n\nInsurance Department which shall be based on the Consumer Price\n\nIndex.
