Stat. tit. 36, § 36-1415.3","heading":"Navigator registration – Application – Requirements -","body":"Violations.\n\nA. No navigator shall provide assistance with regard to health\n\nbenefit plans as a navigator in this state under the provisions of\n\nthe federal act unless registered in accordance with this act. The\n\nInsurance Commissioner must maintain a registry of navigators.\n\nB. An individual applying for a navigator registration shall\n\nmake application on a form developed by the Commissioner and shall\n\ndeclare under penalty of refusal, suspension, or revocation of the\n\nregistration that the statements made in the application are true,\n\ncorrect, and complete to the best of the applicant's knowledge. The\n\nCommissioner may not allow any applicant to register who does not\n\nmeet or conform to the following qualifications or requirements:\n\n1. The applicant shall establish to the satisfaction of the\n\nCommissioner that he or she has read and will comply with written\n\nmaterials provided by the Commissioner concerning ethics, consumer\n\nprivacy, the insurance laws of this state, and any other topic or\n\ntopics the Commissioner deems necessary and attests to such\n\nunderstanding and intent to comply with all state statutes and\n\nrules;\n\n2. The applicant shall attest to an understanding of the\n\ndisclosure and recordkeeping requirements of the registry and the\n\nability to provide and maintain such documents;\n\n3. An applicant shall be not less than eighteen (18) years of\n\nage and of good moral character;\n\n4. The applicant shall successfully complete a criminal history\n\nand regulatory background investigation in the manner that the\n\nCommissioner requires;\n\n5. The applicant shall identify the entity with which he or she\n\nis, or will be, affiliated and supervised; and\n\n6. The applicant shall pay a registration fee prescribed by the\n\nCommissioner not to exceed Fifty Dollars ($50.00).\n\nC. An entity applying for a navigator entity registration shall\n\nmake application on a form developed by the Commissioner and shall\n\ndeclare under penalty of refusal, suspension or revocation of the\n\nregistration that the statements made in the application are true,\n\ncorrect and complete to the best of the applicant's knowledge. The\n\nCommissioner shall not issue a registration to any entity applicant\n\nthat does not meet or conform to the following qualifications or\n\nrequirements:\n\n1. Establishes policies and procedures to ensure that acts that\n\nmay be performed only by a registered navigator or licensed producer\n\nare performed by persons who are appropriately registered or\n\nlicensed;\n\n2. Acknowledges and accepts legal responsibility for the acts\n\nof the individual navigators that it employs, supervises, or is\n\naffiliated with that are performed in this state and that are within\n\nthe scope of the navigator's apparent authority; and\n\n3. Pays a registration fee prescribed by the Commissioner not\n\nto exceed Fifty Dollars ($50.00).\n\nD. The registration of an individual navigator or navigator\n\nentity shall expire one year after issuance. An individual\n\napplicant for a renewal registration shall provide proof that he or\n\nshe has completed continuing education as required under the federal\n\nact and shall establish to the satisfaction of the Commissioner that\n\nhe or she has read and will comply with written materials provided\n\nby the Commissioner concerning ethics, consumer privacy, the\n\ninsurance laws of this state and any other topic or topics the\n\nCommissioner deems necessary and attests to such understanding and\n\nintent to comply with all state statutes and rules.\n\nE. A registered individual navigator must:\n\n1. Provide a disclaimer in a form prescribed by the\n\nCommissioner to each individual or group whom the navigator assists,\n\nwhich shall include the name of the navigator and the navigator\n\nentity;\n\n2. Record the name and contact information for each individual\n\nor group whom the navigator assists in enrolling on the exchange and\n\nthe date of contact and provide such information to the navigator\n\nentity immediately;\nlaimer in a form prescribed by the\n\nCommissioner to each individual or group whom the navigator assists,\n\nwhich shall include the name of the navigator and the navigator\n\nentity;\n\n2. Record the name and contact information for each individual\n\nor group whom the navigator assists in enrolling on the exchange and\n\nthe date of contact and provide such information to the navigator\n\nentity immediately;\n\n3. Allow for an on-site inspection of operations and records\n\nspecifically related to the fulfillment of the enrollment or\n\nassistance with enrollment duties as required by this act by the\n\nnavigator at any time, including providing summary reports as\n\nrequested by the Commissioner, which shall not include personally\n\nidentifiable information. Provided, however, a registered\n\nindividual navigator shall, upon inquiry by the Commissioner, verify\n\nthe name, contact information, and date of contact for an individual\n\nor group assisted in enrolling on the exchange by the navigator;\n\n4. Report to the Commissioner any administrative action taken\n\nby a governmental agency against the navigator in this state or in\n\nany other jurisdiction within thirty (30) calendar days of the final\n\ndisposition of the matter;\n\n5. Report to the Commissioner any criminal prosecution of the\n\nnavigator taken in any jurisdiction within thirty (30) calendar days\n\nof the initial pretrial hearing date; and\n\n6. Notify the Commissioner within ten (10) calendar days of any\n\naction by an exchange or related party that restricts or terminates\n\nthe navigator's authorization to act as a navigator.\n\nF. A registered navigator entity must:\n\n1. Maintain a record of all individuals employed or overseen as\n\na navigator for a period of three (3) years following the\n\ntermination of the employment or oversight of the individual as a\n\nnavigator;\n\n2. Maintain all records required to be provided to the\n\nnavigator entity by registered navigators for a period of three (3)\n\nyears following the termination of the employment or oversight of\n\neach individual as a navigator;\n\n3. Allow for an on-site inspection of operations and records\n\nspecifically related to the fulfillment of the enrollment or\n\nassistance with enrollment duties as required by this act by the\n\nnavigator at any time, including providing summary reports as\n\nrequested by the Commissioner, which shall not include personally\n\nidentifiable information. Provided, however, a registered navigator\n\nentity shall, upon inquiry by the Commissioner, verify the name,\n\ncontact information, and date of contact for an individual or group\n\nassisted in enrolling on the exchange by any navigator employed or\n\noverseen by the navigator entity;\n\n4. Provide the Commissioner with a list of all individual\n\nnavigators that it employs, supervises or is affiliated with, in a\n\nmanner prescribed by the Commissioner; and\n\n5. Report to the Commissioner any termination of employment,\n\nengagement, affiliation or other relationship with an individual\n\nnavigator within thirty (30) days, using a format prescribed by the\n\nCommissioner, if the navigator is terminated for failing to comply\n\nwith any requirement of this title.\n\nG. Any person who acts as a navigator without holding an active\n\nregistration at the time of the action shall be guilty of a\n\nmisdemeanor and shall be punished by the imposition of a fine of not\n\nmore than Two Hundred Fifty Dollars ($250.00) or imprisonment in the\n\ncounty jail for not less than three (3) months nor more than six (6)\n\nmonths, or be punished by both such fine and imprisonment.\n\nH. Any navigator who violates the provisions of this act shall\n\nbe subject to a civil fine of not less than Fifty Dollars ($50.00)\n\nnor more than Five Hundred Dollars ($500.00) for each occurrence.\n\nI. Any navigator entity that allows an individual who is\n\nemployed or overseen by the navigator entity to interact with\n\nindividuals or groups performing any of the functions of a navigator\nrisonment.\n\nH. Any navigator who violates the provisions of this act shall\n\nbe subject to a civil fine of not less than Fifty Dollars ($50.00)\n\nnor more than Five Hundred Dollars ($500.00) for each occurrence.\n\nI. Any navigator entity that allows an individual who is\n\nemployed or overseen by the navigator entity to interact with\n\nindividuals or groups performing any of the functions of a navigator\n\nwithout an active registration shall be subject to a civil fine of\n\nnot more than Five Hundred Dollars ($500.00) for each individual or\n\ngroup with whom the unregistered individual interacts as a navigator\n\nand a civil fine of not more than Fifty Dollars ($50.00) for each\n\nday the unregistered individual performs acts as a navigator.\n\nJ.
