Violation of any provision of Title 36 of the Oklahoma\n\nStatutes or the federal Patient Protection and Affordable Care Act,\n\nincluding any act or omission that would be a ground for denial,\n\nsuspension or revocation of the license of an insurance producer\n\nunder the Oklahoma Producer Licensing Act and of the license of a\n\nmanaging general agent under the Managing General Agents Act, shall\n\nbe a ground for the denial, suspension, revocation, or refusal to\n\nrenew a registration, the levy of a fine or any combination of\n\nactions.\n\nB. Registration as a navigator pursuant to the provisions of\n\nthis act shall not constitute licensing as a producer as defined in\n\nthe Oklahoma Producer Licensing Act.\n\nC. Navigators shall not, except as specifically required by the\n\nprovisions of the federal act:\n\n1. Provide advice about which health benefit plan or benefits,\n\nterms and features of a particular health benefit plan are better or\n\nworse for a particular individual or business;\n\n2. Recommend a particular health benefit plan or advise\n\nindividuals or businesses about which health benefit plan to choose;\n\n3. Receive any commission, compensation or anything of value\n\nfrom any insurer, health benefit plan, business or consumer for\n\nperforming activities specifically required to be provided as a\n\nnavigator pursuant to the provisions of the federal act;\n\n4. Accept any compensation or anything of value that is\n\ndependent, in whole or in part, on whether a person enrolls in or\n\npurchases a health plan;\n\n5. Offer gifts of any value to enrollees or prospective\n\nenrollees as an inducement to, or conditioned upon, the submission\n\nof an application for health insurance or the purchase or renewal of\n\na health plan;\n\n6. Engage in door-to-door solicitations, make unsolicited\n\ntelephone calls, or send unsolicited electronic communications;\n\n7. Solicit any person that is known to be currently insured\n\nunder a health benefit plan;\n\n8. Engage in voter registration activities while performing the\n\nduties of a navigator;\n\n9. Make or cause to be made any communication relating to the\n\nexchange, health benefit plans, an insurance contract, the insurance\n\nbusiness, any insurer or any producer that contains false, deceptive\n\nor misleading information;\n\n10. Engage in any unfair method of competition or any\n\nfraudulent, deceptive or dishonest act or practice; or\n\n11.
