Stat. tit. 36, § 36-1435.12","heading":"Temporary license without examination – Protection of","body":"insureds and public.\n\nA. The Insurance Commissioner may issue a temporary license for\n\na period not to exceed one hundred eighty (180) days without\n\nrequiring an examination if the Insurance Commissioner deems that\n\nthe temporary license is necessary for the servicing of an insurance\n\nbusiness in the following cases:\n\n1. To the surviving spouse or court-appointed personal\n\nrepresentative of a licensed insurance producer who dies or becomes\n\nmentally or physically disabled to allow adequate time for the sale\n\nof the insurance business owned by the producer or for the recovery\n\nor return of the producer to the business or to provide for the\n\ntraining and licensing of new personnel to operate the producer's\n\nbusiness;\n\n2. To a member or employee of a business entity licensed as an\n\ninsurance producer, upon the death or disability of an individual\n\ndesignated in the business entity application or the license;\n\n3. To the designee of a licensed insurance producer entering\n\nactive service in the Armed Forces of the United States of America;\n\nor\n\n4. In any other circumstance in which the Insurance\n\nCommissioner deems that the public interest will best be served by\n\nthe issuance of this license.\n\nB. The Insurance Commissioner may by order limit the authority\n\nof any temporary licensee in any way deemed necessary to protect\n\ninsureds and the public. The Insurance Commissioner may require the\n\ntemporary licensee to have a suitable sponsor who is a licensed\n\nproducer or insurer and who assumes responsibility for all acts of\n\nthe temporary licensee and may impose other similar requirements\n\ndesigned to protect insureds and the public. The Insurance\n\nCommissioner may by order revoke a temporary license if the interest\n\nof insureds or the public are endangered. A temporary license may\n\nnot continue after the owner or the personal representative disposes\n\nof the business. If the applicant fails to pass the licensure\n\nexamination, the temporary license shall terminate automatically.\n\nC. As to a temporary agent's license issued because of the\n\ndeath or disability of an agent, no insurers shall be represented by\n\nthe temporary licensee in addition to those represented by the\n\ndeceased or disabled agent.\n\nD. The fee paid for the temporary license shall not be applied\n\nupon the fee for any permanent license of the same category issued\n\nto the licensee before expiration of the temporary license.\n\nE. No license issued pursuant to the provisions of subsection A\n\nof this section shall be effective for more than six (6) months.\n\nThe Commissioner, in his discretion, may renew the license once upon\n\nproper application and for good cause.
