Stat. tit. 36, § 36-1435.13","heading":"Suspension, revocation or refusal to issue or renew","body":"license – Probation and censure – Grounds – Notice – Fines.\n\nA. The Insurance Commissioner may place on probation, censure,\n\nsuspend, revoke or refuse to issue or renew a license issued\n\npursuant to the Oklahoma Producer Licensing Act or may levy a civil\n\npenalty in accordance with subsection D of this section or any\n\ncombination of actions, for any one or more of the following causes:\n\n1. Providing incorrect, misleading, incomplete or materially\n\nuntrue information in the license application;\n\n2. Violating any insurance laws, or violating any regulation,\n\nsubpoena or order of the Insurance Commissioner or of another\n\nstate’s Insurance Commissioner;\n\n3. Obtaining or attempting to obtain a license through\n\nmisrepresentation or fraud;\n\n4. Improperly withholding, misappropriating or converting any\n\nmonies or properties received in the course of doing insurance\n\nbusiness;\n\n5. Intentionally misrepresenting the terms of an actual or\n\nproposed insurance contract or application for insurance;\n\n6. Having been convicted of a felony;\n\n7. Having admitted or been found to have committed any\n\ninsurance unfair trade practice or fraud;\n\n8. Using fraudulent, coercive or dishonest practices, or\n\ndemonstrating incompetence, untrustworthiness or financial\n\nirresponsibility in the conduct of business in this state or\n\nelsewhere;\n\n9. Having an insurance producer license, or its equivalent,\n\ndenied, suspended, censured, placed on probation or revoked in any\n\nother state, province, district or territory;\n\n10. Forging another’s name to an application for insurance or\n\nto any document related to an insurance transaction;\n\n11. Improperly using notes or any other reference material to\n\ncomplete an examination for an insurance license;\n\n12. Knowingly accepting insurance business from an individual\n\nwho is not licensed;\n\n13. Failing to comply with an administrative or court order\n\nimposing a child support obligation;\n\n14. Failing to pay state income tax or comply with any\n\nadministrative or court order directing payment of state income tax;\n\n15. Failing to respond to an inquiry from the Department as\n\nrequired in Section 1250.4 of this title; or\n\n16. Any cause for which an original issuance of a license could\n\nhave been refused.\n\nB. In the event that the action by the Insurance Commissioner\n\nis to nonrenew or to deny an application for a license, the\n\nInsurance Commissioner shall notify the applicant or licensee and\n\nadvise the applicant or licensee, in writing, of the reason for the\n\ndenial or nonrenewal of the applicant’s or licensee’s license. The\n\napplicant or licensee may make written demand upon the Insurance\n\nCommissioner within thirty (30) days of the date of notification of\n\nthe notification by the Insurance Commissioner for a hearing before\n\nthe Insurance Commissioner or an independent hearing examiner to\n\ndetermine the reasonableness of the Insurance Commissioner’s action.\n\nThe hearing shall be heard within a reasonable time period and shall\n\nbe held pursuant to the Oklahoma Administrative Procedures Act.\n\nC. The license of a business entity may be suspended, revoked\n\nor refused if the Insurance Commissioner finds, after opportunity\n\nfor hearing, that an individual licensee’s violation was known or\n\nshould have been known by one or more of the partners, officers or\n\nmanagers acting on behalf of the partnership or corporation and the\n\nviolation was neither reported to the Insurance Commissioner nor\n\ncorrective action taken.\n\nD. In addition to or in lieu of any applicable denial,\n\nprobation, censure, suspension or revocation of a license, a person\n\nmay, after opportunity for hearing, be subject to a civil fine of\n\nnot more than One Thousand Dollars ($1,000.00) for each occurrence.\n\nThe penalty may be enforced in the same manner in which civil\n\njudgments may be enforced.\n\nE. Every licensee licensed pursuant to the provisions of the\non to or in lieu of any applicable denial,\n\nprobation, censure, suspension or revocation of a license, a person\n\nmay, after opportunity for hearing, be subject to a civil fine of\n\nnot more than One Thousand Dollars ($1,000.00) for each occurrence.\n\nThe penalty may be enforced in the same manner in which civil\n\njudgments may be enforced.\n\nE. Every licensee licensed pursuant to the provisions of the\n\nOklahoma Producer Licensing Act shall keep at the licensee’s place\n\nof business the usual and customary records pertaining to\n\ntransactions authorized by the license. All records as to any\n\nparticular transactions shall be kept available and open to the\n\ninspection of the Commissioner at any time during business hours\n\nduring the three (3) years immediately following the date of\n\ncompletion of the transaction. The Commissioner may require a\n\nfinancial or market conduct examination during any investigation of\n\na licensee. The cost of such examination shall be apportioned among\n\nall of the appointing insurers of the licensee.\n\nF. The Insurance Commissioner shall retain the authority to\n\nenforce the provisions of and impose any penalty or remedy\n\nauthorized by the Oklahoma Producer Licensing Act and this title\n\nagainst any person who is under investigation for or charged with a\n\nviolation of the Oklahoma Producer Licensing Act or this title even\n\nif the person’s license or registration has been surrendered or has\n\nlapsed by operation of law.\n\nG. Files pertaining to investigations or legal matters which\n\ncontain information concurring a current and ongoing investigation\n\nof allegations of violations of the Oklahoma Insurance Code by a\n\nlicensed agent shall not be available for public inspection without\n\nproper judicial authorization; however, a licensee under\n\ninvestigation for alleged violations of the Oklahoma Insurance Code,\n\nor against whom an action for alleged violations of the Oklahoma\n\nInsurance Code has been commenced, may view evidence and complaints\n\npertaining to the investigation, other than privileged information,\n\nat reasonable times at the Commissioner’s office. All qualification\n\nexamination materials, booklets and answers for any license\n\nauthorized to be issued by the Commissioner under any statute shall\n\nnot be available for public inspection. The residence address,\n\nresidence telephone number, birth date and Social Security number of\n\na licensee shall not be available for public inspection. A separate\n\nbusiness or mailing address provided by the licensee shall be\n\nconsidered a public record. If the residence and business addresses\n\nor residence and business telephone numbers are the same, such\n\naddresses or telephone numbers shall be considered a public record.\n\nH. The Commissioner shall promptly notify all appointing\n\ninsurers, where applicable, and the licensee regarding any censure,\n\nsuspension, revocation or termination of license by the\n\nCommissioner.\n\nI. Upon suspension, revocation or termination of the license of\n\na resident or nonresident of this state, the Commissioner shall\n\nnotify the Central Office of the National Association of Insurance\n\nCommissioners, or its appropriate nonprofit affiliates and the\n\nInsurance Commissioner of each state for whom the Commissioner has\n\nexecuted a certificate of licensure status.\n\nJ.
