Stat. tit. 36, § 36-1435.2","heading":"Definitions","body":"As used in the Oklahoma Producer Licensing Act:\n\n1. \"Commissioner\" means the Insurance Commissioner;\n\n2. \"Business entity\" means a corporation, association,\n\npartnership, limited liability company, limited partnership, or\n\nother legal entity;\n\n3. \"Customer service representative\" means an individual who is\n\nrequired to be licensed as an insurance producer under the laws of\n\nthis state and assists the insurance producer, broker, or agency in\n\ntransacting the business of insurance from the office of the\n\ninsurance producer, broker, or agency;\n\n4. \"Home state\" means the District of Columbia and any state or\n\nterritory of the United States in which an insurance producer\n\nmaintains the producer's principal place of residence or principal\n\nplace of business and is licensed to act as an insurance producer;\n\n5. \"Insurance\" means any of the lines of authority in this\n\ntitle including workers' compensation insurance. Any insurer\n\napproved to offer workers' compensation insurance may appoint\n\ninsurance producers. All producers appointed for workers'\n\ncompensation insurance products must be licensed as insurance\n\nproducers by the Oklahoma Insurance Department;\n\n6. \"Insurance consultant\" means an individual or legal entity\n\nwho is required to be licensed as an insurance producer under the\n\nlaws of this state and, for a fee, is held out to the public as\n\nengaged in the business of offering any advice, counsel, opinion or\n\nservice with respect to the benefits, advantages, or disadvantages\n\npromised under any policy of insurance that could be issued or\n\ndelivered in this state;\n\n7. \"Insurance producer\" means a person required to be licensed\n\nunder the laws of this state to sell, solicit or negotiate insurance\n\nand includes a customer service representative and an insurance\n\nconsultant. Any person not duly licensed as an insurance producer,\n\nsurplus lines insurance broker, or limited lines producer who\n\nsolicits a policy of insurance on behalf of an insurer shall be\n\ndeemed to be acting as an insurance agent within the meaning of the\n\nOklahoma Producer Licensing Act, and shall thereby become liable for\n\nall the duties, requirements, liabilities, and penalties to which an\n\ninsurance producer of the company is subject, and the company by\n\nissuing the policy of insurance shall thereby accept and acknowledge\n\nthe person as its agent in the transaction. For purposes of the\n\nlaws of this state and the Oklahoma Insurance Code, the term\n\n\"insurance agent\" means an insurance producer properly appointed by\n\nan insurance carrier to act as an agent for that insurance carrier,\n\npursuant to Section 1435.15 of this title;\n\n8. \"Insurer\" has the meaning set out in Section 103 of this\n\ntitle;\n\n9. \"License\" means a document issued by the Insurance\n\nCommissioner of this state authorizing a person to act as an\n\ninsurance producer for the lines of authority specified in the\n\ndocument. The license itself does not create any authority, actual,\n\napparent or inherent, in the holder to represent or commit an\n\ninsurance carrier;\n\n10. \"Limited line credit insurance\" includes credit life,\n\ncredit disability, credit property, credit unemployment, involuntary\n\nunemployment, mortgage life, mortgage guaranty, mortgage disability,\n\nguaranteed automobile protection insurance, known as \"gap\"\n\ninsurance, and any other form of insurance offered in connection\n\nwith an extension of credit that is limited to partially or wholly\n\nextinguishing that credit obligation that the Insurance Commissioner\n\ndetermines should be designated a form of limited line credit\n\ninsurance;\n\n11. \"Limited line credit insurance producer\" means a person who\n\nsells, solicits or negotiates one or more forms of limited line\n\ncredit insurance coverage to individuals through a master,\n\ncorporate, group or individual policy;\n\n12. \"Limited lines insurance\" means limited line credit and\n\nthose lines of insurance defined in Section 1435.20 of this title or\nform of limited line credit\n\ninsurance;\n\n11. \"Limited line credit insurance producer\" means a person who\n\nsells, solicits or negotiates one or more forms of limited line\n\ncredit insurance coverage to individuals through a master,\n\ncorporate, group or individual policy;\n\n12. \"Limited lines insurance\" means limited line credit and\n\nthose lines of insurance defined in Section 1435.20 of this title or\n\nany other line of insurance the Insurance Commissioner deems\n\nnecessary to recognize for the purposes of complying with subsection\n\nE of Section 1435.9 of this title;\n\n13. \"Limited lines producer\" means a person who is authorized\n\nby the Commissioner to sell, solicit or negotiate limited lines\n\ninsurance. For purposes of the laws of this state and the Oklahoma\n\nInsurance Code, the term \"limited insurance representative\" shall\n\nhave the same meaning as the term \"limited lines producer\";\n\n14. \"Managing general agent\" means an individual or legal\n\nentity appointed, as an independent contractor, by one or more\n\ninsurers to exercise general supervision over the business of the\n\ninsurer in this state, with authority to appoint insurance producers\n\nfor the insurer, and to terminate appointments for the insurer;\n\n15. \"Negotiate\" means the act of conferring directly with or\n\noffering advice directly to a purchaser or prospective purchaser of\n\na particular contract of insurance concerning any of the substantive\n\nbenefits, terms or conditions of the contract, provided that the\n\nperson engaged in that act either sells insurance or obtains\n\ninsurance from insurers for purchaser;\n\n16. \"Person\" means an individual or a business entity;\n\n17. \"Sell\" means to exchange a contract of insurance, by any\n\nmeans, for money or its equivalent, on behalf of an insurance\n\ncompany;\n\n18. \"Solicit\" means attempting to sell insurance or asking or\n\nurging a person to apply for a particular kind of insurance from a\n\nparticular company;\n\n19. \"Surplus lines insurance broker\" means an individual or\n\nlegal entity who solicits, negotiates, or procures a policy of\n\ninsurance in an insurance company not licensed to transact business\n\nin this state which cannot be procured from insurers licensed to do\n\nbusiness in this state. All transactions under such license shall\n\nbe subject to Article 11 of the Oklahoma Insurance Code;\n\n20. \"Terminate\" means the cancellation of the relationship\n\nbetween an insurance producer and the insurer or the termination of\n\na producer's authority to transact insurance;\n\n21. \"Uniform Business Entity Application\" means the current\n\nversion of the National Association of Insurance Commissioners\n\n(NAIC) Uniform Business Entity Application for resident and\n\nnonresident business entities; and\n\n22. \"Uniform Application\" means the current version of the NAIC\n\nUniform Application for resident and nonresident producer licensing.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4ef78b8944f6ad4e9828900c639d43ac0658c035d39d4081199c481866e42bd7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1435.19","next":"us-ok/okla.-stat.-tit.-36-36-1435.20"},"notice":"GroundRules: Original legal text.
