Nothing in the Oklahoma Producer Licensing Act shall be\n\nconstrued to require an insurer to obtain an insurance producer\n\nlicense. In this section, the term \"insurer\" does not include an\n\ninsurer's officers, directors, employees, subsidiaries or\n\naffiliates.\n\nB. A license as an insurance producer shall not be required of\n\nthe following:\n\n1. An officer, director or employee of an insurer or of an\n\ninsurance producer, provided that the officer, director or employee\n\ndoes not receive any commission on policies written or sold to\n\ninsure risks residing, located or to be performed in this state,\n\nand:\n\na. the officer, director or employee's activities are\n\nexecutive, administrative, managerial, clerical or a\n\ncombination of these, and are only indirectly related\n\nto the sale, solicitation or negotiation of insurance,\n\nor\n\nb. the officer, director or employee's function relates\n\nto underwriting, loss control, inspection or the\n\nprocessing, adjusting, investigating or settling of a\n\nclaim on a contract of insurance, or\n\nc. the officer, director or employee is acting in the\n\ncapacity of a special agent or agency supervisor\n\nassisting insurance producers where the person's\n\nactivities are limited to providing technical advice\n\nand assistance to licensed insurance producers and do\n\nnot include the sale, solicitation or negotiation of\n\ninsurance;\n\n2. A person who secures and furnishes information for the\n\npurpose of group life insurance, group property and casualty\n\ninsurance, group annuities, group or blanket accident and health\n\ninsurance; or for the purpose of enrolling individuals under plans,\n\nissuing certificates under plans or otherwise assisting in\n\nadministering plans; or performs administrative services related to\n\nmass-marketed property and casualty insurance, where no commission\n\nis paid to the person for the service;\n\n3. An employer or association or its officers, directors,\n\nemployees, or the trustees of an employee trust plan, to the extent\n\nthat the employers, officers, employees, director or trustees are\n\nengaged in the administration or operation of a program of employee\n\nbenefits for the employer's or association's own employees or the\n\nemployees of its subsidiaries or affiliates, which program involves\n\nthe use of insurance issued by an insurer, as long as the employers,\n\nassociations, officers, directors, employees or trustees are not in\n\nany manner compensated, directly or indirectly, by the company\n\nissuing the contracts;\n\n4. Employees of insurers or organizations employed by insurers\n\nwho are engaging in the inspection, rating or classification of\n\nrisks, or in the supervision of the training of insurance producers\n\nand who are not individually engaged in the sale, solicitation or\n\nnegotiation of insurance;\n\n5. A person whose activities in this state are limited to\n\nadvertising without the intent to solicit insurance in this state\n\nthrough communications in printed publications or other forms of\n\nelectronic mass media whose distribution is not limited to residents\n\nof the state, provided that the person does not sell, solicit or\n\nnegotiate insurance that would insure risks residing, located or to\n\nbe performed in this state;\n\n6. A person who is not a resident of this state who sells,\n\nsolicits or negotiates a contract of insurance for commercial\n\nproperty and casualty risks to an insured with risks located in more\n\nthan one state insured under that contract, provided that that\n\nperson is otherwise licensed as an insurance producer to sell,\n\nsolicit or negotiate that insurance in the state where the insured\n\nmaintains its principal place of business and the contract of\n\ninsurance insures risks located in that state;\n\n7. A salaried full-time employee who counsels or advises his or\n\nher employer relative to the insurance interests of the employer or\n\nof the subsidiaries or business affiliates of the employer, provided\nproducer to sell,\n\nsolicit or negotiate that insurance in the state where the insured\n\nmaintains its principal place of business and the contract of\n\ninsurance insures risks located in that state;\n\n7. A salaried full-time employee who counsels or advises his or\n\nher employer relative to the insurance interests of the employer or\n\nof the subsidiaries or business affiliates of the employer, provided\n\nthat the employee does not sell or solicit insurance or receive a\n\ncommission; or\n\n8. A volunteer counselor assisting Medicare beneficiaries with\n\nenrollment in Medicare Part D plans pursuant to the Federal Medicare\n\nPrescription Drug, Improvement and Modernization Act of 2003, Pub.\n\nLaw No. 108-173, provided that the volunteer counselor does not\n\nreceive commissions or other valuable consideration from any person\n\nor plan for the enrollment, that the volunteer counselor has\n\nreceived education that is acceptable to the Insurance Commissioner\n\non enrollment of Medicare beneficiaries in Medicare Part D, that the\n\nvolunteer counselor is providing volunteer services as part of a\n\nsponsoring agency or organization acceptable to the Commissioner,\n\nand that supporting documentation and/or verification is provided to\n\nthe Commissioner as set out by rule.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e2c821fd95d67a68efa250494c307f24a928bf39d0f053afcb4285afae4ec161","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1435.41","next":"us-ok/okla.-stat.-tit.-36-36-1435.6"},"notice":"GroundRules: Original legal text.
