Stat. tit. 36, § 36-1442","heading":"Definitions","body":"As used in the Third-party Administrator Act, Section 1441 et\n\nseq. of this title:\n\n1. \"Administrator\" means any person who collects premiums for\n\nan insurer or trust or who adjusts or settles claims for an insurer\n\nor trust, in connection with life or health insurance coverage,\n\nannuities or employee benefit stop loss in this state, but shall not\n\ninclude any person who collects premiums or who adjusts or settles\n\nclaims under the following circumstances:\n\na. any employer on behalf of the employees of that\n\nemployer or the employees of one or more subsidiary or\n\naffiliated corporations of that employer,\n\nb. a union on behalf of its members,\n\nc. an insurance company which is licensed to transact\n\ninsurance business in this state,\n\nd. a wholly owned subsidiary of an entity which is\n\nsubject to the jurisdiction of the Insurance\n\nCommissioner,\n\ne. an insurance company acting as an insurer with respect\n\nto a policy lawfully issued and delivered by said\n\ncompany in and pursuant to the laws of this state,\n\nf. a hospital, medical, dental, or optometric service\n\ncorporation or a health care service organization,\n\nincluding their agents, authorized by the Commissioner\n\nto issue contracts in this state pursuant to the\n\nprovisions of the Oklahoma Insurance Code when engaged\n\nin the performance of their duties,\n\ng. a life or disability agent or broker who is licensed\n\nin this state and whose activities are limited\n\nexclusively to the sale of insurance,\n\nh. an adjuster licensed in this state for the kinds of\n\nbusiness for which he is acting as an adjuster,\n\ni. a creditor insuring a debt between the creditor and\n\nits debtors on behalf of said creditor's debtors,\n\nj. a financial institution which is subject to\n\nsupervision or examination by federal or state banking\n\nauthorities,\n\nk. a company which issues credit cards and advances\n\ncredit for and collects premiums or charges from its\n\ncredit card holders who have authorized said\n\ncollection, if the company does not adjust or settle\n\nclaims,\n\nl. a person who adjusts or settles claims in the normal\n\ncourse of practice or employment as an attorney-at-law\n\nand who does not collect charges or premiums in\n\nconnection with life or health insurance coverage or\n\nannuities,\n\nm. any workers' compensation trust, or\n\nn. a trust providing benefits to the employees of any\n\npolitical subdivision of a city, county or the state;\n\nand\n\n2. \"Trust\" means any trust other than those exempted in\n\nparagraph 1 of this section which engages in the business of making\n\ncontracts of insurance.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4efd792e42b3ee1a844dfa2325beef631aef58a0d511b1782f65886e70d33469","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1441.1","next":"us-ok/okla.-stat.-tit.-36-36-1443"},"notice":"GroundRules: Original legal text.
