Every domestic insurer shall, on or prior to each March 1,\n\nwhich shall be known as the filing date, prepare and submit to the\n\nInsurance Commissioner a report of its RBC Levels as of the end of\n\nthe calendar year just ended, in a form and containing such\n\ninformation as is required by the RBC Instructions, as adopted by\n\nthe Commissioner by rule. In addition, every domestic insurer shall\n\nfile its RBC Report with the NAIC if required by the Commissioner.\n\nB. 1. A life and health insurer's or fraternal benefit\n\nsociety's RBC shall be determined in accordance with the formula set\n\nforth in the RBC Instructions, as adopted by the Commissioner by\n\nrule. The formula shall take into account, and may adjust for the\n\ncovariance between, the following factors:\n\na. the risk with respect to the insurer's assets,\n\nb. the risk of adverse insurance experience with respect\n\nto the insurer's liabilities and obligations,\n\nc. the interest rate risk with respect to the insurer's\n\nbusiness, and\n\nd. all other business risks and such other relevant risks\n\nas are set forth in the RBC Instructions.\n\n2. These factors shall be determined in each case by applying\n\nthe factors in the manner set forth in the RBC Instructions.\n\nC. 1. A property and casualty insurer's RBC shall be\n\ndetermined in accordance with the formula set forth in the RBC\n\nInstructions, as adopted by the Commissioner by rule. The formula\n\nshall take into account, and may adjust for the covariance between,\n\nthe following factors:\n\na. asset risk,\n\nb. credit risk,\n\nc. underwriting risk, and\n\nd. all other business risks and such other relevant risks\n\nas are set forth in the RBC Instructions.\n\n2. These factors shall be determined in each case by applying\n\nthe factors in the manner set forth in the RBC Instructions.\n\nD. If a domestic insurer files an RBC Report which in the\n\njudgment of the Commissioner is inaccurate, then the Commissioner,\n\nafter notice and opportunity for comment, shall adjust the RBC\n\nReport to correct the inaccuracy and shall notify the insurer of the\n\nadjustment. The notice shall contain a statement of the reason for\n\nthe adjustment.
