RBC Reports and RBC Plans shall be kept confidential by the\n\nInsurance Commissioner. This information shall not be subject to\n\nsubpoena. This information shall be made public by the Commissioner\n\nonly for the purpose of enforcement actions taken by the\n\nCommissioner pursuant to this act or any other provision of the\n\ninsurance laws of this state.\n\nB. Except as otherwise required under the provisions of this\n\nact, the making, publishing, disseminating, circulating, or placing\n\nbefore the public, or causing, directly or indirectly, to be made,\n\npublished, disseminated, circulated, or placed before the public, in\n\na newspaper, magazine, or other publication, or in the form of a\n\nnotice, circular, pamphlet, letter, or poster, or over any radio or\n\ntelevision station, or in any other way, an advertisement,\n\nannouncement, or statement containing an assertion, representation,\n\nor statement with regard to the RBC Levels of any insurer, or of any\n\ncomponent derived in the calculation, by an insurer, agent, broker,\n\nor other person engaged in any manner in the insurance business is\n\nmisleading and is therefore prohibited. Any person who violates\n\nthis subsection shall be subject to a civil penalty in an amount not\n\nless than One Thousand Dollars ($1,000.00) nor more than Ten\n\nThousand Dollars ($10,000.00).\n\nC. The RBC Reports and RBC Plans are intended solely for use by\n\nthe Commissioner in monitoring the solvency of insurers and the need\n\nfor possible corrective action with respect to insurers. The RBC\n\nReports and RBC Plans shall not be used by the Commissioner for\n\nratemaking nor considered or introduced as evidence in any rate\n\nproceeding nor used by the Commissioner to calculate or derive any\n\nelements of an appropriate premium level or rate of return for any\n\nline of insurance which an insurer or any affiliate is authorized to\n\nwrite.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2233316bd7399d8898a5554ddf73d8314b5087f45b8752be123d55f2435490f3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1528","next":"us-ok/okla.-stat.-tit.-36-36-1530"},"notice":"GroundRules: Original legal text.
