Stat. tit. 36, § 36-1530","heading":"Provisions of act supplemental – Promulgation of rules -","body":"Exemptions from act.\n\nA. The provisions of this act are supplemental to any other\n\nprovisions of the laws of this state, and shall not preclude or\n\nlimit any other powers or duties of the Insurance Commissioner under\n\nsuch laws, including, but not limited to, Article 18 or 19 of the\n\nInsurance Code.\n\nB. The Commissioner may promulgate reasonable rules necessary\n\nfor the implementation of this act.\n\nC. The Commissioner may exempt from the application of this act\n\nin any year any domestic insurer which:\n\n1. Writes direct business only in this state; and\n\n2. Assumes no reinsurance in excess of five percent (5%) of\n\ndirect premium written.\n\nD. Insurers domiciled in this state that are issuing policies\n\nof medical professional liability insurance to physicians, allied\n\nhealth care professionals and health care institutions as defined by\n\nSection 2202 of this title on July 1, 2004, which notify the\n\nCommissioner in writing of the insurer’s election to utilize the\n\nmoratorium provided in Section 1509 of this title shall be exempt\n\nfrom the provisions of this title which require an insurer to\n\nmaintain an adequate surplus as regards policyholders as a condition\n\nto obtaining or renewal of a license to act as an insurer, until\n\nDecember 31, 2008. The Commissioner shall not enforce any\n\nrecapitalization plan against any insurer domiciled in this state\n\nthat is issuing policies of physicians’, allied health care\n\nprofessionals’ and health care institutions’ professional liability\n\ninsurance until December 31, 2008.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d37f878625698e859696e61021a871d8e02125980c786a2f343c29edebe6601e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1529","next":"us-ok/okla.-stat.-tit.-36-36-1531"},"notice":"GroundRules: Original legal text.
