Any foreign insurer shall, upon the written request of\n\nthe Insurance Commissioner, submit to the Commissioner an RBC Report\n\nas of the end of the calendar year just ended on a date which is the\n\nlater of:\n\na. the date an RBC Report would be required to be filed\n\nby a domestic insurer under this act, or\n\nb. fifteen (15) days after the request is received by the\n\nforeign insurer.\n\n2. Any foreign insurer shall, at the written request of the\n\nCommissioner, promptly submit to the Commissioner a copy of any RBC\n\nPlan that is filed with the Insurance Commissioner of any other\n\nstate.\n\nB. 1. The Commissioner may require a foreign insurer to file\n\nan RBC Plan with the Commissioner in the event of a Company Action\n\nLevel Event, Regulatory Action Level Event, or Authorized Control\n\nLevel Event. The filing shall be made pursuant to the RBC statute\n\napplicable in the state of domicile of the insurer or, if no RBC\n\nstatute is in force in that state, pursuant to the provisions of\n\nthis act. If the insurance commissioner of the state of domicile of\n\nthe foreign insurer fails to require the foreign insurer to file an\n\nRBC Plan in the manner specified under that state's RBC statute or,\n\nif no RBC statute is in force in that state, the filing shall be\n\nmade pursuant to Section 5 of this act.\n\n2. The failure of the foreign insurer to file an RBC Plan with\n\nthe Commissioner shall be grounds to order the insurer to cease and\n\ndesist from writing new insurance business in this state.\n\nC. In the event of a Mandatory Control Level Event with respect\n\nto any foreign insurer, if no domiciliary receiver has been\n\nappointed with respect to the foreign insurer under the\n\nrehabilitation and liquidation statute applicable in the state of\n\ndomicile of the foreign insurer, the Commissioner may make\n\napplication to the Oklahoma County District Court as permitted under\n\nArticle 19 of the Oklahoma Insurance Code with respect to the\n\nliquidation of property of foreign insurers found in this state.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8a2785ff3f5a7bd31d2d5edc3eee4e3efd1769debfd2293a2f25b07a7600c278","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1530","next":"us-ok/okla.-stat.-tit.-36-36-1532"},"notice":"GroundRules: Original legal text.
