Stat. tit. 36, § 36-1638","heading":"Commissioner power to participate in supervisory","body":"colleges.\n\nA. With respect to any insurer registered under Section 5 of\n\nthis act, and in accordance with subsection C of this section, the\n\nCommissioner shall also have the power to participate in a\n\nsupervisory college for any domestic insurer that is part of an\n\ninsurance holding company system with international operations in\n\norder to determine compliance by the insurer with Title 36 of the\n\nOklahoma Statutes. The powers of the Commissioner with respect to\n\nsupervisory colleges include, but are not limited to, the following:\n\n1. Initiating the establishment of a supervisory college;\n\n2. Clarifying the membership and participation of other\n\nsupervisors in the supervisory college;\n\n3. Clarifying the functions of the supervisory college and the\n\nrole of other regulators, including the establishment of a group-\n\nwide supervisor;\n\n4. Coordinating the ongoing activities of the supervisory\n\ncollege, including planning meetings, supervisory activities, and\n\nprocesses for information sharing; and\n\n5. Establishing a crisis management plan.\n\nB. Each registered insurer subject to this section shall be\n\nliable for and shall pay the reasonable expenses of the\n\nCommissioner's participation in a supervisory college in accordance\n\nwith subsection C of this section, including reasonable travel\n\nexpenses. For purposes of this section, a supervisory college may\n\nbe convened as either a temporary or permanent forum for\n\ncommunication and cooperation between the regulators charged with\n\nthe supervision of the insurer or its affiliates, and the\n\nCommissioner may establish a regular assessment to the insurer for\n\nthe payment of these expenses.\n\nC. In order to assess the business strategy, financial\n\nposition, legal and regulatory position, risk exposure, risk\n\nmanagement and governance processes, and as part of the examination\n\nof individual insurers in accordance with Section 7 of this act, the\n\nCommissioner may participate in a supervisory college with other\n\nregulators charged with supervision of the insurer or its\n\naffiliates, including other state, federal and international\n\nregulatory agencies. The Commissioner may enter into agreements in\n\naccordance with subsection C of Section 10 of this act providing the\n\nbasis for cooperation between the Commissioner and the other\n\nregulatory agencies, and the activities of the supervisory college.\n\nNothing in this section shall delegate to the supervisory college\n\nthe authority of the Commissioner to regulate or supervise the\n\ninsurer or its affiliates within its jurisdiction.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"52e2d57b62b2664a7488911e1d7fb67935b9a96146ce5efb455b04dd41e942c3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1637","next":"us-ok/okla.-stat.-tit.-36-36-1639"},"notice":"GroundRules: Original legal text.
