If the Commissioner believes that the controlling\n\nproducer or any other person has not materially complied with the\n\nBusiness Transacted with Producer Controlled Insurer Act, or any\n\nregulation or order promulgated hereunder, after notice and\n\nopportunity to be heard, the Commissioner may order the controlling\n\nproducer to cease placing business with the controlled insurer; and\n\n2. If it was found that because of such material noncompliance\n\nthat the controlled insurer or any policyholder thereof has suffered\n\nany loss or damage, the Commissioner may maintain a civil action or\n\nintervene in an action brought by or on behalf of the insurer or\n\npolicyholder for recovery of compensatory damages for the benefit of\n\nthe insurer or policyholder or other appropriate relief.\n\nB. If an order for liquidation or rehabilitation of the\n\ncontrolled insurer has been entered pursuant to Section 1903 of\n\nTitle 36 of the Oklahoma Statutes, and the receiver appointed under\n\nthat order believes that the controlling producer or any other\n\nperson has not materially complied with this act, or any regulation\n\nor order promulgated hereunder, and the insurer suffered any loss or\n\ndamage therefrom, the receiver may maintain a civil action for\n\nrecovery of damages or other appropriate sanctions for the benefit\n\nof the insurer.\n\nC. Nothing contained in this section shall affect the right of\n\nthe Commissioner to impose any other penalties provided for in the\n\nInsurance Code.\n\nD.
