Whenever notice is required to be given under the Insurance\n\nBusiness Transfer Act and except as otherwise permitted or directed\n\nby the court or the Insurance Commissioner, the notice shall be\n\ntransmitted within forty-five (45) days of the event triggering the\n\nrequirement:\n\n1. By first-class mail, postage prepaid to the chief insurance\n\nregulator in each jurisdiction in which the transferring insurer:\n\na. holds or has ever held a certificate of authority, and\n\nb. in which policies that are part of the subject\n\nbusiness were issued or policyholders currently\n\nreside;\n\n2. By certified first-class mail, postage prepaid to the\n\nNational Conference of Insurance Guaranty Funds, the National\n\nOrganization of Life and Health Insurance Guaranty Associations and\n\nall state insurance guaranty associations for the states in which\n\nthe transferring insurer:\n\na. holds or has ever held a certificate of authority, and\n\nb. in which policies that are part of the subject\n\nbusiness were issued or policyholders currently\n\nreside;\n\n3. To reinsurers of the transferring insurer pursuant to the\n\nnotice provisions of the reinsurance agreements applicable to the\n\npolicies that are part of the subject business, or where an\n\nagreement has no provision for notice, by internationally recognized\n\ndelivery service;\n\n4. By United States mail, first-class postage prepaid, or by\n\nany internationally recognized delivery service, to all\n\npolicyholders holding policies that are part of the subject\n\nbusiness, at their last-known address as indicated by the records of\n\nthe transferring insurer or to the address to which premium notices\n\nor other policy documents are sent. Notice shall also be sent to\n\nthe transferring insurer's agents or brokers of record on the\n\nsubject business;\n\n5. By electronic means to any person or entity identified in\n\nsubsection A of this section who provided consent to notice or\n\nservice in an agreement included in or related to the subject\n\nbusiness or otherwise consents in writing to receiving service by\n\nelectronic mail and provides instructions for making the electronic\n\nnotice or service. For the purposes of this subsection, \"electronic\n\nmeans\" shall include communications by facsimile or electronic mail;\n\nand\n\n6. By publication in a newspaper of general circulation in the\n\nstate in which the transferring insurer has its principal place of\n\nbusiness and in such other publications that the Commissioner\n\nrequires.\n\nB. If notice is given in accordance with this section, any\n\ninformation or orders under this act shall be conclusive with\n\nrespect to all intended recipients of the notice, whether or not the\n\nintended recipients receive actual notice.\n\nC.
