At the time of filing its application with the Insurance\n\nCommissioner for review and approval of an Insurance Business\n\nTransfer Plan, the applicant shall pay a nonrefundable fee to the\n\nInsurance Department in the amount of Ten Thousand Dollars\n\n($10,000.00).\n\nB. In the Commissioner's discretion, in connection with the\n\nDepartment's participation in the proceedings undertaken pursuant to\n\nthe Insurance Business Transfer Act, the applicant shall reimburse\n\nthe Department for any compensation and benefits paid to the\n\npersonnel of the Department for time spent engaged in the\n\nproceedings, including but not limited to examiners, actuaries,\n\nattorneys, managers and paraprofessionals.\n\nC. The Commissioner may retain independent attorneys,\n\nappraisers, actuaries, certified public accountants, or other\n\nprofessionals and specialists to assist Department personnel in\n\nconnection with the review required by the Insurance Business\n\nTransfer Act, the cost of which shall be borne by the applicant.\n\nD. The applicant shall pay the expenses of the Department and\n\nits authorized consultants incurred in fulfilling their obligations\n\nunder this act, including the actual expenses of the Department or\n\nthe expenses and compensation of any consultants retained by the\n\nDepartment.\n\nE. The transferring insurer and the assuming insurer shall\n\njointly be obligated to pay any compensation, costs and expenses of\n\nthe independent expert and any consultants retained by the\n\nindependent expert and approved by the Department incurred in\n\nfulfilling the obligations of the independent expert under this act.\n\nNothing in this act shall be construed to create any duty for the\n\nindependent expert to any party other than the Department or the\n\nCourt.\n\nF. Failure to pay any of the requisite fees or reimbursements\n\nwithin thirty (30) days of demand shall be grounds for the\n\nCommissioner to request that the court dismiss the petition for\n\napproval of the Insurance Business Transfer Plan prior to the filing\n\nof an implementation order by the court or, if after the filing of\n\nan implementation order, the Commissioner may suspend or revoke the\n\nassuming insurer's certificate of authority to transact insurance\n\nbusiness in this state.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"12da4b4377c96360a7e9db27607ddf78c8aa2d5c709d0b7ccafbc0c4ca60c337","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1687","next":"us-ok/okla.-stat.-tit.-36-36-1691"},"notice":"GroundRules: Original legal text.
