The Insurance Commissioner shall, if there is substantial\n\nreason to believe that any insurer is insolvent, or if any insurer's\n\ncondition is such as to render the continuance of its business\n\nhazardous to the public or to holders of its policies or\n\ncertificates of insurance, or it has exceeded its powers, or it has\n\nfailed to comply with the law, or if such insurer gives its consent:\n\n1. Notify the insurer of the Commissioner's determination;\n\n2. Furnish the insurer a written list of requirements to abate\n\nthe Commissioner's determination; and\n\n3. If the Commissioner makes a further determination to\n\nsupervise, notify the insurer that it is under supervision pursuant\n\nto this article.\n\nB. Such insurer shall comply with the lawful requirements of\n\nthe Commissioner and, if placed under supervision, shall have ninety\n\n(90) days from the date of notice within which to comply with the\n\nrequirements of the Commissioner unless the Commissioner designates\n\na lesser or greater period of time or unless the Commissioner\n\ndetermines at any time during or after the ninety-day period of time\n\nthat judicial or administrative proceedings should be initiated to\n\nplace such insurer in conservation, rehabilitation or liquidation\n\nproceedings or other delinquency proceedings, pursuant to Articles\n\n18 and 19 of this title.
