In the event that the Commissioner makes any of the findings\n\nprovided for in Section 3 of this act concerning any foreign or\n\nalien insurer or finds that any such insurer is not possessed of the\n\nminimum surplus or capital required by the Insurance Code of this\n\nstate for similar type domestic companies, or if a conservator,\n\nrehabilitator, receiver or liquidator has been appointed in the\n\nstate of domicile, or if the insurer gives its consent, the\n\nCommissioner shall have the same power and jurisdiction to appoint a\n\nsupervisor or conservator as to the assets of such insurer located\n\nin this state as provided herein for domestic insurance companies.\n\nB. In the event that any such insurer shall fail to comply with\n\nthe provisions of Section 4 of this act with respect to any of its\n\nassets or policies located within this state during any 90-day\n\nperiod of supervision, such act or violation shall constitute\n\nsufficient grounds for the immediate revocation of its certificate\n\nof authority to do business in this state and for the immediate\n\nappointment of a conservator to take charge of its assets located\n\nwithin this state.\n\nC. Any supervisor or conservator appointed with respect to\n\nassets located in this state belonging to a foreign or alien insurer\n\nshall have all of the power and authority provided for in Section 5\n\nof this act with respect to such assets located in this state and,\n\nin addition, may reinsure all or any part of such insurer's\n\npolicyholders or certificate holders located within this state with\n\ninsurers authorized to transact business in this state and may\n\ntransfer to the reinsuring company, as reserve funds, assets or any\n\nportion thereof in his possession as may be required to consummate\n\nthe reinsurance of such policies and any of such assets transferred\n\nas reserve funds shall not be deemed a preference of creditors.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bd356d5d2cba426c24244d520a1c45c22e51ab733344b6cbe3952cdb833081cd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-1806","next":"us-ok/okla.-stat.-tit.-36-36-1808"},"notice":"GroundRules: Original legal text.
