Stat. tit. 36, § 36-1915","heading":"Conduct of delinquency proceedings against foreign","body":"insurers.\n\nA. Whenever under this article an ancillary receiver is to be\n\nappointed in delinquency proceedings for an insurer not domiciled in\n\nthis state, the court shall appoint the Insurance Commissioner as\n\nancillary receiver. The Insurance Commissioner shall file a\n\npetition requesting the appointment on the grounds set forth in\n\nsection 1809 of this article (1) if he finds that there are\n\nsufficient assets of the insurer located in this state to justify\n\nthe appointment of an ancillary receiver, or (2) if ten (10) or more\n\npersons resident in this state having claims against such insurer\n\nfile a petition with the Insurance Commissioner requesting the\n\nappointment of such ancillary receiver.\n\nB. The domiciliary receiver for the purpose of liquidating an\n\ninsurer domiciled in a reciprocal state shall be vested by operation\n\nof law with the title to all of the property, contracts, and rights\n\nof action and all of the books and records of the insurer located in\n\nthis state, and he shall have the immediate right to recover\n\nbalances due from local agents and to obtain possession of any books\n\nand records of the insurer found in this state. He shall also be\n\nentitled to recover the other assets of the insurer located in this\n\nstate, except that upon the appointment of an ancillary receiver in\n\nthis state, the ancillary receiver shall during the ancillary\n\nreceivership proceedings have the sole right to recover such other\n\nassets. The ancillary receiver shall, as soon as practicable,\n\nliquidate from their respective securities those special deposit\n\nclaims and secured claims which are proved and allowed in the\n\nancillary proceedings in this state, and shall pay the necessary\n\nexpense of the proceedings. All remaining assets he shall promptly\n\ntransfer to the domiciliary receiver. Subject to the foregoing\n\nprovisions, the ancillary receiver and his deputies shall have the\n\nsame powers and be subject to the same duties with respect to the\n\nadministration of such assets as a receiver of an insurer domiciled\n\nin this state.\n\nC.
