The Oklahoma Property and Casualty Insurance Guaranty\n\nAssociation shall submit to the Commissioner a plan of operation and\n\nany amendments thereto necessary or suitable to assure the fair,\n\nreasonable and equitable administration of the Association. The\n\nplan of operation and any amendments thereto shall become effective\n\nupon approval in writing by the Commissioner.\n\nB. If the Association fails to submit a suitable plan of\n\noperation within ninety (90) days following June 27, 1980, or if at\n\nany time thereafter the Association fails to submit suitable\n\namendments to the plan, the Commissioner shall, after notice and\n\nhearing, adopt and promulgate reasonable rules as are necessary or\n\nadvisable to effectuate the provisions of Section 2001 et seq. of\n\nthis title. Any rules promulgated shall continue in force until\n\nmodified by the Commissioner or superseded by a plan submitted by\n\nthe Association and approved by the Commissioner. All member\n\ninsurers shall comply with the plan of operation.\n\nC. The plan of operation shall:\n\n1. Establish the procedures whereby all the powers and duties\n\nof the Association under this act will be performed;\n\n2. Establish procedures for handling assets of the Association;\n\n3. Require the amount and method of reimbursing members of the\n\nboard of directors under Section 2006 of this title;\n\n4. Establish procedures by which claims may be filed with the\n\nAssociation and establish acceptable forms of proof of covered\n\nclaims;\n\n5. Establish regular places and times for meetings of the board\n\nof directors;\n\n6. Require that the written procedures be established for\n\nrecords to be kept of all financial transactions of the Association,\n\nits agents and the board of directors;\n\n7. Provide that any member insurer aggrieved by any final\n\naction or decision of the Association may appeal to the Commissioner\n\nwithin thirty (30) days after the action or decision;\n\n8. Establish the procedures whereby selections for the board of\n\ndirectors will be submitted to the Commissioner; and\n\n9. Contain additional provisions necessary or proper for the\n\nexecution of the powers and duties of the Association.\n\nD. The plan of operation may provide that any or all powers and\n\nduties of the Association, except those under paragraph 3 of\n\nsubsection A and paragraph 2 of subsection B of Section 2007 of this\n\ntitle, are delegated to a corporation, association or other\n\norganization which performs or will perform functions similar to\n\nthose of this Association, or its equivalent. The corporation,\n\nassociation or organization shall be reimbursed as a servicing\n\nfacility would be reimbursed and shall be paid for its performance\n\nof any other functions of the Association.
