The Commissioner shall:\n\n1. Notify the Oklahoma Property and Casualty Insurance Guaranty\n\nAssociation Executive Director of the existence of an insolvent\n\ninsurer as soon as possible but not later than three (3) days after\n\nnotice of the determination is received. The Association shall be\n\nentitled to a copy of a complaint seeking an order of liquidation\n\nwith a finding of insolvency against a member company at the same\n\ntime that the complaint is filed with a court of competent\n\njurisdiction; and\n\n2. Provide the Association with a statement of the net direct\n\nwritten premiums of each member insurer upon the request of the\n\nboard of directors.\n\nB. The Commissioner may:\n\n1. Suspend or revoke, after the notice and hearing, the\n\ncertificate of authority to transact insurance in this state of any\n\nmember insurer which fails to pay an assessment when due or fails to\n\ncomply with the plan of operation. As an alternative, the\n\nCommissioner may levy a fine on any member insurer which fails to\n\npay an assessment when due. The fine shall not exceed five percent\n\n(5%) of the unpaid assessment per month, except that no fine shall\n\nbe less than One Hundred Dollars ($100.00) per month;\n\n2. Revoke the designation of any servicing facility if the\n\nCommissioner finds claims are being handled unsatisfactorily; or\n\n3. Examine or audit the Association.\n\nC.
