In addition to the duties and powers enumerated elsewhere in\n\nthis act, the Commissioner shall:\n\n1. Upon request of the Board, provide the Association with a\n\nstatement of the premiums in the appropriate states for each member\n\ninsurer;\n\n2. When an impairment is declared and the amount of the\n\nimpairment is determined, serve a demand upon the impaired insurer\n\nto make good the impairment within a reasonable time. Notice to the\n\nimpaired insurer shall constitute notice to its shareholders, if\n\nany. The failure of the insurer to promptly comply with such demand\n\nshall not excuse the Association from the performance of its powers\n\nand duties under this act.\n\nIf a foreign or alien member insurer is subject to a liquidation\n\nproceeding in its domiciliary jurisdiction or state of entry, the\n\nCommissioner shall be appointed conservator or shall be permitted to\n\ninitiate an ancillary receivership.\n\nB. The Commissioner may suspend or revoke, after notice and\n\nhearing, the certificate of authority to transact insurance business\n\nin this state of any member insurer which fails to pay an assessment\n\nwhen due or fails to comply with the procedural rules. As an\n\nalternative, the Commissioner may levy a forfeiture on any member\n\ninsurer which fails to pay an assessment when due. Such forfeiture\n\nshall not exceed five percent (5%) of the unpaid assessment per\n\nmonth, but no forfeiture shall be less than One Hundred Dollars\n\n($100.00) per month.\n\nC.
