The Insurance Commissioner shall annually review\n\nnegotiations between the trust and any entity to provide\n\nadministrative, claim, underwriting or claim management services or\n\nexcess insurance, aggregate excess insurance and reinsurance to the\n\ntrust.\n\nB. The Commissioner shall, at least twice yearly, review and\n\nevaluate each category of operations of the trust or association as\n\nfollows:\n\n1. Underwriting policies and activities, including all new\n\napplications for coverage, as well as all decisions regarding denial\n\nof new policies and surcharges on or nonrenewal of existing\n\ninsureds;\n\n2. Summaries of all claims activities, including number of\n\nclaims filed, lawsuits filed, resolution of closed claims and\n\nlawsuits, amounts paid in settlements, jury verdicts, defense\n\nattorney fees, expert witness costs and other defense costs;\n\n3. Consumer satisfaction with quality of service by the trust\n\nor its agents;\n\n4. Investment activities;\n\n5. All filed base rates and proposed rate increases; and\n\n6. All risk-management activities, including continuing\n\neducation and counseling of insureds.\n\nC.
