Stat. tit. 36, § 36-2653","heading":"Certificate of authority; requirements","body":"The Insurance Commissioner shall issue a certificate of\n\nauthority authorizing the applicant to issue contracts to its\n\nsubscribers when it is shown to the satisfaction of the Commissioner\n\nthat:\n\n1. The applicant is established as a bona fide nonprofit\n\noptometric service or indemnity corporation;\n\n2. The contracts between the applicant and the participating\n\noptometrists, if any, obligate each optometrist executing the same\n\nto render service to which each subscriber may be entitled under the\n\nterms of the contract to be issued to the subscribers;\n\n3. The amounts provided as working capital of the corporation\n\nare repayable, without interest, out of operating expenses;\n\n4. The amount of money actually available for working capital\n\nis sufficient to carry on the plan for a period of three (3) months\n\nfrom the date of issuance of the certificate of authority; and\n\n5. The applicant has secured contracts of participation from\n\nsufficient optometrists to provide ample protection for its\n\nsubscribers within the area proposed to be served by the applicant.\n\n6.
