Stat. tit. 36, § 36-2673","heading":"Certificate of authority - Requirements","body":"The Insurance Commissioner shall certify nonprofit dental\n\nservice corporations by issuing a certificate of authority,\n\nauthorizing the applicant to issue contracts to its subscribers,\n\nwhen it is shown to the satisfaction of the Commissioner that:\n\n1. The applicant is established as a bona fide nonprofit dental\n\nservice corporation;\n\n2. The contracts between the applicant and the participating\n\ndentists or other providers of health services, if any, obligate\n\neach provider executing the same to render service to which each\n\nsubscriber may be entitled under the terms of the contract to be\n\nissued to the subscribers;\n\n3. The amount of required working capital of the corporation is\n\npaid into the corporation and, if subject to repayment, can be\n\nrepaid, but without interest, and only out of operating income;\n\n4. The amount of money actually available for working capital\n\nis sufficient to carry on the plan for a period of three (3) months\n\nfrom the date of issuance of the certificate of authority; and\n\n5. The applicant has secured signed contracts of participation\n\nfrom not less than one-third (1/3) of the dentists within this state\n\nwho hold a current license issued by the Board of Dentistry pursuant\n\nto the State Dental Act.
