The records, books, and papers pertaining to the official\n\ntransactions, filings, examinations, investigations, and proceedings\n\nof the Insurance Department shall be maintained by the Department\n\nuntil disposition thereof has been approved by the Archives and\n\nRecords Commission. These records, books, and papers shall be\n\npublic records of the state. However, reports of examinations of\n\ninsurers shall be filed and made public only as provided in Section\n\n309.4 of this title. Open and ongoing investigative and\n\ndisciplinary files shall not be made public until their completion\n\nor unless they are ordered to be made public by the proper judicial\n\nofficial. Files of the claims division of the office of the\n\nCommissioner, including but not limited to complaints and requests\n\nfor assistance from insureds, and insurance agency and company\n\nrecords, shall not be public records and shall not be disclosed\n\nexcept in connection with disciplinary proceedings by the\n\nCommissioner. Final market conduct orders shall be open public\n\nrecords.\n\nB. Any document or other information generated by the Insurance\n\nDepartment or received by the Insurance Department from a\n\ngovernmental agency or any other public body of any kind, including\n\nan insurance guaranty fund or risk pool board, that has a protection\n\nfrom disclosure under any statute or evidentiary privilege from\n\ndisclosure, while in the possession of the body that generated or\n\nreceived the information, shall retain its confidential character\n\nwhile in the possession of the Insurance Department. The Insurance\n\nDepartment may require that any agency or public body providing a\n\ndocument or other information, if it expects the information to be\n\ntreated confidentially by the Insurance Department, to also provide\n\nsimultaneously an express reference to the claimed protection from\n\ndisclosure.\n\nC.
