Effective July 1, 2009, there is hereby created in the State\n\nTreasury a revolving fund for the Insurance Commissioner called the\n\nState Insurance Commissioner Revolving Fund. The revolving fund\n\nshall be used to fund the operations of the Office of the Insurance\n\nCommissioner.\n\n1. Notwithstanding any other law to the contrary, the revolving\n\nfund shall consist of and consolidate all funds that are or have\n\nbeen paid or collected by the Insurance Commissioner pursuant to the\n\nlaws of this state and the rules of the Insurance Department except\n\nthat the revolving fund shall not include:\n\na. premium taxes,\n\nb. monies transferred to the Attorney General's Insurance\n\nFraud Unit Revolving Fund pursuant to Section 362 of\n\nthis title,\n\nc. funds paid to and collected pursuant to the Oklahoma\n\nCertified Real Estate Appraisers Act, Sections 858-700\n\nthrough 858-732 of Title 59 of the Oklahoma Statutes,\n\nd. health carrier access payments paid to and collected\n\nby the Insurance Commissioner and deposited into the\n\nHealth Carrier Access Payment Revolving Fund,\n\ne. recoveries obtained as a result of insurance-related\n\ncrimes, and other fines, late fees, and penalties\n\nassessed and collected, and\n\nf. monies collected for or received from the Workers'\n\nCompensation Commission.\n\n2. The revolving fund shall be a continuing fund, not subject\n\nto fiscal year limitations. Expenditures from the revolving fund\n\nshall be made pursuant to the laws of this state and the statutes\n\nrelating to the Insurance Department. Warrants for expenditures\n\nfrom the revolving fund shall be drawn by the State Treasurer, based\n\non claims signed by an authorized employee or employees of the\n\nInsurance Department and filed with the Director of the Office of\n\nManagement and Enterprise Services.\n\nB. All funds collected by the Insurance Commissioner shall be\n\npaid into the State Treasury weekly.\n\nC. After the effective date of this act, the State Treasury is\n\nauthorized and directed to deduct from the funds paid or collected\n\nby the Insurance Commissioner a sum equal to seventy-six and one-\n\nhalf percent (76.5%) of the payment and place the same to the credit\n\nof the General Revenue Fund of the state.
