Stat. tit. 36, § 36-309.3","heading":"Appointment of examiner - Compliance with examiner's","body":"requests - Powers of Commissioner.\n\nA. Upon determining that an examination should be conducted,\n\nthe Insurance Commissioner shall issue an examination warrant\n\nappointing one or more examiners to perform the examination and\n\ninstructing them as to the scope of the examination. In conducting\n\nthe examination, the examiner shall observe those guidelines and\n\nprocedures set forth in the Examiners' Handbook adopted by the\n\nNational Association of Insurance Commissioners as supplemented by\n\nrules of the Commissioner. The Commissioner may also employ such\n\nother guidelines or procedures as the Commissioner may deem\n\nappropriate.\n\nB. Every company or person from whom information is sought,\n\nincluding all of its officers, directors, employees and agents,\n\nshall provide to the Commissioner and examiners timely, convenient,\n\nand free access at all reasonable hours at its offices to all books,\n\nrecords, accounts, papers, documents, and any or all computer or\n\nother recordings relating to the property, assets, business and\n\naffairs of the company being examined. The officers, directors,\n\nemployees and agents of the company or person shall facilitate such\n\nexamination and aid in such examination so far as it is in their\n\npower to do so. The refusal of any company, by its officers,\n\ndirectors, employees or agents, to submit to examination or to\n\ncomply with any reasonable written request of the examiners shall be\n\ngrounds for suspension or refusal of, or nonrenewal of any license\n\nor authority held by the company to engage in an insurance or other\n\nbusiness subject to the Commissioner's jurisdiction. Any such\n\nproceedings for suspension, revocation or refusal of any license or\n\nauthority shall be conducted pursuant to Section 619 of this title.\n\nC. The Commissioner or examiners shall have the power to issue\n\nsubpoenas, to administer oaths and to examine under oath any person\n\nas to any matter pertinent to the examination. Upon the failure or\n\nrefusal of any person to obey a subpoena, the Commissioner may\n\npetition a court of competent jurisdiction, and upon proper showing,\n\nthe Court may enter any order compelling the witness to appear and\n\ntestify or produce documentary evidence. Failure to obey the court\n\norder shall be punishable as contempt of court.\n\nD. When making an examination under Sections 309.1 through\n\n309.7 of this title, the Commissioner may retain attorneys,\n\nappraisers, independent actuaries, independent certified public\n\naccountants or an accounting firm or individual holding a permit to\n\npractice public accounting, certified financial examiners or other\n\nprofessionals and specialists as examiners, the cost of which shall\n\nbe borne by the company which is the subject of the examination.\n\nE. Nothing contained in Sections 309.1 through 309.7 of this\n\ntitle shall be construed to limit the Commissioner's authority to\n\nterminate or suspend any examination in order to pursue other legal\n\nor regulatory action pursuant to the insurance laws of this state.\n\nFindings of fact and conclusions made in any examination report\n\nshall be prima facie evidence in any legal or regulatory action.\n\nF. Nothing contained in Sections 309.1 through 309.7 of this\n\ntitle shall be construed to limit the Commissioner's authority to\n\nuse and, if appropriate, to make public any final or preliminary\n\nexamination report, any examiner or company workpapers or other\n\ndocuments, or any other information discovered or developed during\n\nthe course of any examination in the furtherance of any legal or\n\nregulatory action which the Commissioner may deem appropriate.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1c3f070316d8a9e7ba901c1a0955ffaa26fdc1480a210f52880ee99d57f70fdc","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-309.2","next":"us-ok/okla.-stat.-tit.-36-36-309.4"},"notice":"GroundRules: Original legal text.
