No examiner may be appointed by the Insurance Commissioner\n\nif such examiner, either directly or indirectly, has a conflict of\n\ninterest or is affiliated with the management of or owns a pecuniary\n\ninterest in any person subject to examination under Sections 309.1\n\nthrough 309.7 of this title. This section shall not be construed to\n\nautomatically preclude an examiner from being:\n\n1. A policyholder or claimant under an insurance policy;\n\n2. A grantor of a mortgage or similar instrument on such\n\nexaminer's residence to a regulated entity if done under customary\n\nterms and in the ordinary course of business;\n\n3. An investment owner in shares of regulated diversified\n\ninvestment companies; or\n\n4. A settlor or beneficiary of a blind trust into which any\n\notherwise impermissible holdings have been placed.\n\nB. Notwithstanding the requirements of this section, the\n\nCommissioner may retain from time to time, on an individual basis,\n\nqualified actuaries, an accounting firm or individual holding a\n\npermit to practice public accounting in this state, or other similar\n\nindividuals who are independently practicing their professions, even\n\nthough said persons may from time to time be similarly employed or\n\nretained by persons subject to examination under this act.
