No cause of action shall arise nor shall any liability be\n\nimposed against the Insurance Commissioner, the Commissioner's\n\nauthorized representatives, or any examiner appointed by the\n\nCommissioner for any statements made or conduct performed while\n\ncarrying out the provisions of Sections 309.1 through 309.7 of this\n\ntitle, unless the conduct was objectively unreasonable and outside\n\nthe scope of the person's duties.\n\nB. No cause of action shall arise, nor shall any liability be\n\nimposed against any person for the act of communicating or\n\ndelivering information or data to the Commissioner or the\n\nCommissioner's authorized representative or examiner pursuant to an\n\nexamination made under Sections 309.1 through 309.7 of this title,\n\nif such act of communication or delivery was not a fraudulent or\n\ncriminal act.\n\nC. This section does not abrogate or modify in any way any\n\ncommon law or statutory privilege or immunity heretofore enjoyed by\n\nany person identified in subsection A of this section.\n\nD. A person identified in subsection A of this section shall be\n\nentitled to an award of attorney's fees and costs if determined to\n\nbe the prevailing party in a civil action arising out of activities\n\nin carrying out the provisions of Sections 309.1 through 309.7 of\n\nthis title, if the court determines that the party bringing the\n\naction was not substantially justified in doing so.
