Stat. tit. 36, § 36-3101","heading":"Definitions","body":"As used in this act:\n\n1. \"Commissioner\" means the Commissioner of Insurance, his or\n\nher assistants or deputies, or other persons authorized to act for\n\nhim or her;\n\n2. \"Company\" means any person, firm, copartnership, company,\n\nassociation or corporation engaged in selling, furnishing or\n\nprocuring, either as principal or producer, for a consideration,\n\nmotor club service;\n\n3. \"Producer\" means an insurance producer or a limited lines\n\nproducer who solicits the purchase of service contracts or transmits\n\nfor another any such contract, or application therefor, to or from\n\nthe company, or acts or aids in any manner in the delivery or\n\nnegotiation of any such contract, or in the renewal or continuance\n\nthereof. This, however, shall not include any person performing\n\nonly work of a clerical nature in the office of the motor club;\n\n4. \"Towing service\" means any act by a company which consists\n\nof towing or moving a motor vehicle from one place to another under\n\nother than its own power;\n\n5. \"Emergency road service\" means any act by a company to\n\nadjust, repair or replace the equipment, tires or mechanical parts\n\nof a motor vehicle so it may operate under its own power; or\n\nreimbursement of expenses incurred by a member when his or her motor\n\nvehicle is unable to operate under its own power;\n\n6. \"Insurance service\" means any act to sell or give to the\n\nholder of a service contract or as a result of membership in or\n\naffiliation with a company a policy of insurance covering the holder\n\nfor liability or loss for personal injury or property damage\n\nresulting from the ownership, maintenance, operation or use of a\n\nmotor vehicle;\n\n7. \"Bail bond service\" means any act by a company to furnish or\n\nprocure a cash deposit, bond or other undertaking required by law\n\nfor any person accused of a law violation of this state, pending\n\ntrial;\n\n8. \"Discount service\" means any act by a company resulting in\n\nspecial discounts, rebates or reductions of price on gasoline, oil,\n\nrepairs, insurance, parts, accessories or service for motor vehicles\n\nto holders of service contracts;\n\n9. \"Financial service\" means any act by a company to loan or\n\notherwise advance monies, with or without security, to a service\n\ncontract holder;\n\n10. \"Buying and selling service\" means any act by a company to\n\naid the holder of a service contract in the purchase or sale of an\n\nautomobile;\n\n11. \"Theft service\" means any act by a company to locate,\n\nidentify or recover a stolen or missing motor vehicle owned or\n\ncontrolled by the holder of a service contract or to detect or\n\napprehend the person guilty of such theft;\n\n12. \"Map service\" means any act by a company to furnish road\n\nmaps without cost to holders of service contracts;\n\n13. \"Touring service\" means any act by a company to furnish\n\ntouring information without cost to holders of service contracts;\n\n14. \"Legal service\" means any act by a company to furnish to a\n\nservice contract holder, without cost, the services of an attorney;\n\n15. \"Motor service club\" means the rendering, furnishing or\n\nprocuring of, or reimbursement for three or more of the following:\n\ntowing service, emergency road service, insurance service, bail bond\n\nservice, legal service, discount service, financial service, buying\n\nand selling service, theft service, map service, and touring service\n\nto any person, in connection with the ownership, operation, use, or\n\nmaintenance of a motor vehicle by such person, that has membership,\n\nfor consideration; and\n\n16. \"Service contract\" means any written agreement whereby any\n\ncompany, for a consideration, promises to render, furnish or procure\n\nfor any person motor club service.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4ebcb847eb0366a13c6d1fa943f8964ae754db1aa9de2c37184bf095649ec72f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-309.7","next":"us-ok/okla.-stat.-tit.-36-36-3102"},"notice":"GroundRules: Original legal text.
