All insurers authorized to do business under the\n\nprovisions of this Code shall, annually, on or before the first day\n\nof March, file with the National Association of Insurance\n\nCommissioners (NAIC), statements which shall exhibit the financial\n\ncondition of insurers on the thirty-first day of December of the\n\nprevious year and its business of that year. Annual statements\n\nshall be filed electronically as approved by the NAIC, along with\n\napplicable fees. Domestic insurers shall file a printed annual\n\nfinancial statement along with all supplement filings in the office\n\nof the Insurance Commissioner annually on or before the first day of\n\nMarch.\n\n2. Foreign insurers shall file an Affidavit of Filing and\n\nFinancial Statement Attestation annually on or before the first day\n\nof March. The Insurance Commissioner may require foreign insurers\n\nto file the annual financial statement in a printed format. Such\n\ndocument required by the Insurance Commissioner shall be due\n\nannually on or before the first day of March.\n\n3. For good cause shown, the Insurance Commissioner may extend\n\nthe time within which such statements may be filed. The statements\n\nshall be in such general form and context as approved by the\n\nNational Association of Insurance Commissioners for the kinds of\n\ninsurance to be reported upon, and as supplemented for additional\n\ninformation required by the Insurance Commissioner by rule. In\n\naddition, the statements shall be prepared in accordance with the\n\nNAIC annual statement instruction handbooks, including any\n\nsupplemental filings described in the NAIC annual instruction\n\nhandbook, and follow the accounting procedures and practices\n\nprescribed by the NAIC accounting practices and procedure manuals as\n\nsupplemented by the Insurance Commissioner by rule. The assets and\n\nliabilities shall be computed pursuant to the most conservative\n\nmethod allowed by the laws of this state. Such statements shall be\n\nsubscribed and sworn to by the president and secretary and other\n\nproper officers. The license or certificate of authority to\n\ntransact the business of insurance in this state shall be renewed\n\nunless the Insurance Commissioner finds that the facts do not\n\nwarrant renewal, and that the insurer has not fully complied with\n\nall laws applicable to the insurer. Upon initial licensure, the\n\nCommissioner shall issue a license, or certificate of authority,\n\nsubject to all requirements and conditions of the law, to transact\n\nbusiness in this state, specifying in the certificate the particular\n\nkind or kinds of insurance it is authorized to transact. The annual\n\nstatement of an insurer of a foreign country shall embrace only its\n\nbusiness and condition in the United States, and shall be subscribed\n\nand sworn to by its resident manager or principal representative in\n\ncharge of its United States business, or other officer duly\n\nauthorized. Any amendments and addendums to the annual statement\n\nsubsequently filed with the Commissioner shall also be filed with\n\nthe National Association of Insurance Commissioners, and the insurer\n\nshall pay the applicable filing fees.\n\nB. In the absence of actual malice, or gross negligence,\n\nmembers of the National Association of Insurance Commissioners,\n\ntheir duly authorized committees, subcommittees and task forces,\n\ntheir delegates, National Association of Insurance Commissioners'\n\nemployees, and all others charged with the responsibility of\n\ncollecting, reviewing, analyzing and disseminating the information\n\ndeveloped from the filing of the annual statement shall be acting as\n\nagents of the Commissioner under the authority of this section and\n\nshall not be subject to civil liability for libel, slander or any\n\nother cause of action by virtue of their collection, review and\n\nanalysis or disseminating of the data and information collected from\nting, reviewing, analyzing and disseminating the information\n\ndeveloped from the filing of the annual statement shall be acting as\n\nagents of the Commissioner under the authority of this section and\n\nshall not be subject to civil liability for libel, slander or any\n\nother cause of action by virtue of their collection, review and\n\nanalysis or disseminating of the data and information collected from\n\nthe filings required under this section.\n\nC.
