Insurers authorized to do business under the provisions of\n\nthe Oklahoma Insurance Code shall annually file with the Insurance\n\nCommissioner market conduct annual statements reporting market\n\nconduct data of insurers on the thirty-first day of December of the\n\nprevious year. The statements shall report on the lines of\n\ninsurance and be in such general form and context as approved by the\n\nNational Association of Insurance Commissioners (NAIC), and as\n\nsupplemented for additional information required by the Insurance\n\nCommissioner by rule. The statements shall be prepared in\n\naccordance with NAIC instructions including any supplemental filings\n\ndescribed in the NAIC instructions. If no forms or instructions are\n\navailable from the National Association of Insurance Commissioners,\n\nthe statements shall be in the form and pursuant to instructions and\n\ndeadlines as provided by the Insurance Commissioner. Insurers not\n\nauthorized by the Insurance Commissioner to provide the lines of\n\ninsurance approved by the National Association or the Insurance\n\nCommissioner shall not be required to file market conduct annual\n\nstatements. For good cause shown, the Insurance Commissioner may\n\nextend the time within which market conduct annual statements may be\n\nfiled. The Insurance Commissioner may provide copies of market\n\nconduct annual statements, amendments, and addendums to such\n\nstatements and market conduct data taken from such statements to the\n\nNational Association of Insurance Commissioners only if, prior to\n\nsharing of the market conduct annual statements, amendments,\n\naddendums to such statements or market conduct data taken from such\n\nstatements, the National Association of Insurance Commissioners\n\nenters into a written agreement with the Insurance Commissioner to\n\nmaintain the confidentiality of the shared information.\n\nB. The Insurance Commissioner may adopt rules implementing this\n\nsection including rules that:\n\n1. Add lines of insurance to be reported in market conduct\n\nannual statements; and\n\n2. Require the filing of market conduct annual statements and\n\nany amendments and addendums to such statements with the National\n\nAssociation of Insurance Commissioners, and the payment of\n\napplicable filing fees required by the NAIC.\n\nC. Insurers shall pay a filing fee of Two Hundred Dollars\n\n($200.00) to the Insurance Commissioner for the filing of the market\n\nconduct annual statement due at the time of filing, in accordance\n\nwith NAIC filing deadlines.\n\nD. No waiver of an applicable privilege or claim of\n\nconfidentiality in the documents, materials, or other information\n\nshall occur as a result of disclosure to the Insurance Commissioner\n\nor the Commissioner’s designee under this section or as a result of\n\nsharing the documents, materials or other information as provided in\n\nthis section.\n\nE. Market conduct annual statements and any amendments and\n\naddendums to such statements, filed with the Insurance Commissioner\n\npursuant to this section in electronic format or otherwise, shall be\n\ntreated as working papers and documents as set out in subsection F\n\nof Section 309.4 of this title.\n\nF. The Insurance Commissioner may use market conduct annual\n\nstatements or amendments or addendums to such statements to assist\n\nin determining whether a market conduct examination or investigation\n\nof an insurer should be conducted. For purposes of completing a\n\nmarket conduct examination of any company under Sections 309.1\n\nthrough 309.7 of this title, the Insurance Commissioner may, in the\n\nsole discretion of the Insurance Commissioner, use market conduct\n\nannual statements or amendments or addendums to such statements to\n\nassist in determining compliance with the laws of this state and\n\nrules adopted by the Insurance Commissioner.\n\nG. For any violation of this section, the Insurance\nthis title, the Insurance Commissioner may, in the\n\nsole discretion of the Insurance Commissioner, use market conduct\n\nannual statements or amendments or addendums to such statements to\n\nassist in determining compliance with the laws of this state and\n\nrules adopted by the Insurance Commissioner.\n\nG. For any violation of this section, the Insurance\n\nCommissioner may, after notice and opportunity for a hearing,\n\nsubject an insurer to a civil penalty of up to One Thousand Dollars\n\n($1,000.00) for each occurrence.
