No insurance policy form or application form, where written\n\napplication is required and is to be made a part of the policy,\n\nrider or endorsement form other than surety bond forms and such\n\nother insurance policy forms as are hereinafter specifically\n\notherwise provided for shall be issued, delivered, or used unless\n\nfiled with and approved by the Insurance Commissioner. This section\n\nshall not apply to policies, riders or endorsements of unique\n\ncharacter designed for and used with relation to insurance upon a\n\nparticular subject or which relate to the manner of distribution of\n\nbenefits or to the reservation of rights and benefits under life or\n\naccident and health policies, and are used at the request of the\n\nindividual policyholder, contract holder, or certificate holder.\n\nB. Every such filing shall be made not less than sixty (60)\n\ndays in advance of any such delivery. At the expiration of such\n\nsixty (60) days the form so filed shall be deemed approved unless\n\nprior thereto it has been affirmatively approved or disapproved by\n\norder of the Insurance Commissioner. Approval of any such form by\n\nthe Commissioner shall constitute a waiver of any unexpired portion\n\nof such waiting period. The Insurance Commissioner may extend by\n\nnot more than an additional thirty (30) days the period within which\n\nhe may so affirmatively approve or disapprove any such form, by\n\ngiving notice of such extension before expiration of the initial\n\nsixty-day period. At the expiration of any such period as so\n\nextended, and in the absence of such prior affirmative approval or\n\ndisapproval, any such form shall be deemed approved. The Insurance\n\nCommissioner may at any time, after notice and for cause shown,\n\nwithdraw any such approval.\n\nC. Any order of the Insurance Commissioner disapproving any\n\nsuch form or withdrawing a previous approval shall state the grounds\n\ntherefor.\n\nD. The Insurance Commissioner may, by order, exempt from the\n\nrequirements of this section for so long as he deems proper any\n\ninsurance document or form or type thereof as specified in such\n\norder, to which, in his discretion this section may not practicably\n\nbe applied, or the filing and approval of which are, in his opinion,\n\nnot desirable or necessary for the protection of the public.\n\nE. This section shall apply also to any such form used by\n\ndomestic insurers for delivery in a jurisdiction outside Oklahoma,\n\nif the insurance supervisory official of such jurisdiction informs\n\nthe Insurance Commissioner that such form is not subject to approval\n\nor disapproval by such official, and upon the Commissioner's order\n\nrequiring the form to be submitted to him for the purpose.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8d07ee6512db7f7725911d8a580d925f1218b2368e2f6c929d26264cfd9852d7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-361","next":"us-ok/okla.-stat.-tit.-36-36-3611"},"notice":"GroundRules: Original legal text.
