No person who maintains genetic information shall be\n\ncompelled to disclose such information pursuant to a request for\n\ncompulsory disclosure in any judicial, legislative, or\n\nadministrative proceeding, unless:\n\n1. The request for compulsory disclosure is in accordance with\n\ncourt-ordered paternity testing in a civil action to determine\n\npaternity;\n\n2. The individual whose genetic information is requested is a\n\nparty to the proceeding and the genetic information is at issue;\n\n3. The individual whose genetic information was requested was\n\ninsured under an insurance policy and the policy as well as the\n\ngenetic information is at issue; or\n\n4. The genetic information is for use in a law enforcement\n\nproceeding or investigation or in instances where an insurer\n\nanticipates or is reporting fraud or criminal activity.\n\nB. Notwithstanding any language in this section to the\n\ncontrary, this section shall not apply to an insurer or to an\n\nindividual or third-party dealing with an insurer in the ordinary\n\ncourse of underwriting, conducting, or administering the business of\n\nlife, disability income, or long-term care insurance or in\n\nconnection with any judicial, legislative or administrative\n\nproceeding relating to life, disability income or long-term care\n\ninsurance.
