This section shall be known and may be cited as the “Genetic\n\nResearch Studies Nondisclosure Act”.\n\nB. For purposes of the Genetic Research Studies Nondisclosure\n\nAct, “genetic research study or studies” shall mean those genetic\n\nresearch studies approved by an institutional review board as\n\ndefined in 21 CFR, Section 50 or conducted subject to the\n\nrequirements of the federal common rule at 21 CFR, Section 50 and\n\nSection 56, and 45 CFR, Section 46.\n\nC. All research records of individual subjects in genetic\n\nresearch studies shall be confidential, meaning the records shall\n\nnot be subject to subpoena or discovery in civil suits, except in\n\ncases where the information in the records is the basis of the suit.\n\nThe records shall not be disclosed to employers or health insurers\n\nwithout the informed consent of the subject.\n\nD. Notwithstanding any language in this section to the\n\ncontrary, this section shall not apply to an insurer or to an\n\nindividual or third party dealing with an insurer in the ordinary\n\ncourse of underwriting, conducting or administering the business of\n\nlife, disability income or long-term care insurance or in connection\n\nwith any judicial, legislative or administrative proceeding relating\n\nto life, disability income or long-term care insurance. Nothing in\n\nthis section is intended to govern an insurer or to govern an\n\nindividual or third party dealing with an insurer in connection with\n\nthe obtaining, maintaining, use, disclosure or redisclosure of\n\ngenetic information or the results of a genetic test, including but\n\nnot limited to records of individual subjects in genetic research in\n\nconnection with life, disability income or long-term care insurance\n\nor in connection with any judicial, legislative or administrative\n\nproceeding relating to life, disability income or long-term care\n\ninsurance.\n\nE. All stored tissues, including blood, that arise from\n\nsurgery, other diagnostic or therapeutic steps, or autopsy may be\n\ndisclosed for genetic or other research studies if informed consent\n\nhas been obtained. Informed consent may be included in a section of\n\nthe consent for treatment, admission to a hospital or clinic, or\n\npermission for an autopsy and no other consent shall be required.\n\nF. It shall be permissible to publish or otherwise use the\n\nresults of genetic research studies for research or educational\n\npurposes if no individual subject is identified.
