Nothing in this Code shall be construed to prevent an\n\ninsurer from charging and collecting in this state separate initial\n\nmembership fees, policy fees and any other fees as defined in\n\nsubsection C of this section in addition to premiums for insurance,\n\nand such fees shall not be considered premium within the definition\n\nof this Code, but shall be subject to premium tax as provided in\n\nthis Code. An insurer shall fully disclose all fees to its\n\ncustomers.\n\nB. A minimum premium charge is considered premium within the\n\ndefinition of this Code, and shall be subject to premium tax as\n\nprovided in this Code.\n\nC. 1. Fees are defined as a flat amount added to the basic\n\npremium rate to reflect the cost of establishing the required\n\nrecords, sending premium notices and other related expenses and\n\ninclude, but are not limited to, the following: Installment fees,\n\nservice charges, financing fees, membership fees, return check fees,\n\npolicy fees, motor vehicle record fees, inspection fees, late fees,\n\nelectronic transfer fees, credit score fees and expense load fees.\n\n2. The fee passed on to the consumer must be the actual expense\n\nincurred by the insurance company, insurance agency or insurance\n\nproducer.\n\nD. Minimum premium charge is the smallest acceptable premium\n\nfor which an insurance company will write a policy. This minimum\n\ncharge is necessary to cover fixed expenses, other than those\n\nexpenses defined as fees above, in placing the policy on the books.\n\nA minimum premium charge includes, but is not limited to, minimum\n\nearned premium and minimum retained premium.\n\nE.
