Notwithstanding the provisions of Section 3624 of this\n\ntitle, whenever an insurer who has not discharged its obligation to\n\nmake payments to an individual for medical services, and if that\n\nindividual has received medical assistance from the Department of\n\nHuman Services, then the insurer, upon notice that medical\n\nassistance has been furnished, shall make its payments directly to\n\nthe Department of Human Services, but not to exceed the amount of\n\nmedical assistance paid by the Department of Human Services or\n\nmedical service rendered by the Department.\n\nB. Provided further, and notwithstanding the provisions of\n\nSection 3626 of this title, any insurer who, after having been put\n\non notice of payment of a medical claim or claims or the rendering\n\nof medical services by the Department of Human Services, and in\n\ndisregard of said notice, subsequently makes payments on the same\n\nclaim or claims to persons or entities other than the Department of\n\nHuman Services shall not be discharged from payment to the\n\nDepartment of Human Services in the sum and amount claimed by the\n\nDepartment. Payment to the Department by the insurer under the\n\nprovisions of this section shall discharge the insurer's obligation\n\nwith respect to all further payment on the claim or claims for the\n\namount paid.\n\nC. Provided, further, that the notice requirements of this act\n\nare satisfied (1) when the insurer receives a copy of the claims\n\npaid or medical services rendered by the Department of Human\n\nServices together with a request for reimbursement by certified or\n\nregistered mail, or (2) when the insurer receives a claim from a\n\nbeneficiary containing information to the effect that the\n\nbeneficiary has applied for or has received medical assistance from\n\nthe Department of Human Services in connection with the same claim\n\nas set forth in Section 3 of this act.\n\nThe insurer who receives such claim shall notify the Department\n\nof Human Services of its obligation on such claim and shall pay the\n\nobligation to the provider of service or if the Department of Human\n\nServices has provided medical assistance thereon, pay the Department\n\nof Human Services.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ea0a261b894498b68740a7ba8890417b0c66a23e2db68fee21de0eac648ddcc2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-3624.2","next":"us-ok/okla.-stat.-tit.-36-36-3624.4"},"notice":"GroundRules: Original legal text.
