Stat. tit. 36, § 36-4024","heading":"Limit of liability - Life insurance policy application","body":"denial.\n\nA. No policy of life insurance shall be delivered or issued for\n\ndelivery in this state if it contains a provision which excludes or\n\nrestricts liability for death caused in a certain specified manner\n\nor occurring while the insured has a specified status, except that a\n\npolicy may contain provisions excluding or restricting coverage as\n\nspecified therein in the event of death under any one or more of the\n\nfollowing circumstances:\n\n1. Death as a result of a declared war or military action.\n\n2. Death resulting from violations of the conditions of the\n\npolicy relating to service, travel, or flight in any species of\n\naircraft, other than as a fare-paying passenger in a licensed\n\npassenger aircraft, piloted by a licensed passenger pilot on a\n\nregular passenger route between definitely established airports.\n\n3. Death within two (2) years from the date of issue of the\n\npolicy as a result of suicide, while sane or insane; provided, that\n\nin the event of death as a result of suicide within two (2) years\n\nfrom the date of issue of the policy the insurer shall return the\n\namount of all premiums paid.\n\nB. A policy which contains any exclusion or restriction\n\npursuant to paragraphs 1 and 2 of subsection A of this section shall\n\nalso provide that in the event of death under the circumstances to\n\nwhich any such exclusion or restriction is applicable, the insurer\n\nwill pay an amount not less than a reserve determined according to\n\nthe reserve valuation method and upon the basis of the mortality\n\ntable and interest rate specified in the policy for the calculation\n\nof nonforfeiture benefits (or if the policy provides for no such\n\nbenefits, computed according to a mortality table and interest rate\n\ndetermined by the insurer and specified in the policy) with\n\nadjustment for indebtedness or dividend credit.\n\nC. A life insurance company doing business within this state\n\nshall not deny or refuse to accept an application for life insurance\n\nor refuse to renew, cancel, restrict, or otherwise terminate a\n\npolicy of life insurance, or charge a different rate for the same\n\nlife insurance coverage, based upon the lawful travel destinations\n\nof the applicant or the insured. Nothing in this subsection shall\n\nprohibit a life insurance company from denying an application for\n\nlife insurance, or restricting or charging a different premium or\n\nrate for coverage under such a policy based on a specific travel\n\ndestination where the denial, restriction, or rate differential is\n\nbased upon sound actuarial principles or is related to actual or\n\nanticipated experience. A violation of this subsection shall be an\n\nunfair trade practice pursuant to Section 1250.5 of this title. The\n\nprovisions of this subsection shall apply to any life insurance\n\npolicy issued on or after the effective date of this act.\n\nD. This section shall not apply to group life insurance,\n\naccident and health insurance, reinsurance, or annuities, or to any\n\nprovision in a life insurance policy relating to disability benefits\n\nor to additional benefits in the event of death by accident or\n\naccidental means, except as provided in subsection C of this\n\nsection.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"17e15eedd6a22eac5f24984e6595231f60d7f31c90e41ff97f4171a8f41fcbc2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-4023","next":"us-ok/okla.-stat.-tit.-36-36-4025"},"notice":"GroundRules: Original legal text.
