No policy of individual accident and health insurance shall\n\nbe delivered or issued for delivery to any person in this state\n\nunless:\n\n1. the entire money and other considerations therefor are\n\nexpressed therein;\n\n2. the time at which the insurance takes effect and terminates\n\nis expressed therein;\n\n3. it purports to insure only one person, except that a policy\n\nmay insure, originally or by subsequent amendment, upon the\n\napplication of an adult member of a family who shall be deemed the\n\npolicyholder, any two or more eligible members of that family,\n\nincluding husband, wife, dependent children or any children under a\n\nspecified age which shall not exceed twenty-two (22) years and any\n\nother person dependent upon the policyholder;\n\n4. the style, arrangement and overall appearance of the policy\n\ngive no undue prominence to any portion of the text, and unless\n\nevery printed portion of the text of the policy and of any\n\nendorsement or attached papers is plainly printed in lightfaced type\n\nof a style in general use, the size of which shall be uniform and\n\nnot less than ten-point with a lowercase unspaced alphabet length\n\nnot less than one hundred twenty points (the \"text\" shall include\n\nall printed matter except the name and address of the insurer, name\n\nor title of the policy, the brief description if any, and captions\n\nand subcaptions); when a policy is renewable only at the option of\n\nthe company, such fact shall be made known in prominent lettering on\n\nthe face of the policy;\n\n5. the exceptions and reductions of indemnity are set forth in\n\nthe policy and, except those which are set forth in Section 4405 of\n\nthis article, are printed, at the insurer's option, either included\n\nwith the benefit provision to which they apply, or under an\n\nappropriate caption such as \"Exceptions,\" or \"Exceptions and\n\nReductions,\" provided that if an exception or reduction specifically\n\napplies only to a particular benefit of the policy, a statement of\n\nsuch exception or reduction shall be included with the benefit\n\nprovision to which it applies;\n\n6. each such form, including riders and endorsements, shall be\n\nidentified by a form number in the lower left-hand corner of the\n\nfirst page thereof;\n\n7. it contains no provision purporting to make any portion of\n\nthe charter, rules, constitution, or bylaws of the insurer a part of\n\nthe policy unless such portion is set forth in full in the policy,\n\nexcept in the case of the incorporation of, or reference to, a\n\nstatement of rates or classification of risks, or short rate table\n\nfiled with the Insurance Commissioner; and\n\n8. in such policies, except accident insurance only policies,\n\nin which the insurer reserves the right to refuse renewal on an\n\nindividual basis, it shall provide, in substance, in a provision\n\nthereof or in an endorsement thereon or in a rider attached thereto,\n\nthat, subject to the right to terminate the policy upon nonpayment\n\nof premium when due, such right to refuse renewal may not be\n\nexercised so as to take effect before the renewal date occurring on,\n\nor after and nearest, each anniversary (or in the case of lapse and\n\nreinstatement at the renewal date occurring on, or after and\n\nnearest, each anniversary of the last reinstatement) and that any\n\nrefusal of renewal shall be without prejudice to any claim\n\noriginating while the policy is in force. (The parenthetic\n\nreference to lapse and reinstatement may be omitted at the option of\n\nthe insurer.)\n\nB. If the terms of any individual or franchise accident and\n\nhealth insurance policy cover services within the lawful scope of\n\npractice of a licensed psychologist then:\n\n1. such services may be performed by any person licensed to do\n\nso under the \"Psychologists Licensing Act,\" Title 59 of the Oklahoma\n\nStatutes, Sections 1351 through 1375.\n\n2. selection of a licensed psychologist may be made by the\n\ninsured at his option and, provided other conditions of the policy\nsurance policy cover services within the lawful scope of\n\npractice of a licensed psychologist then:\n\n1. such services may be performed by any person licensed to do\n\nso under the \"Psychologists Licensing Act,\" Title 59 of the Oklahoma\n\nStatutes, Sections 1351 through 1375.\n\n2. selection of a licensed psychologist may be made by the\n\ninsured at his option and, provided other conditions of the policy\n\nare met, reimbursement shall not be denied when service is rendered\n\nby a person so licensed.\n\n3. the provisions of this act shall apply to the policies and\n\ncontracts of insurance, which are delivered, amended, ratified, or\n\nissued for delivery in Oklahoma after this act takes effect.\n\n4. any provision, exclusion, or limitation of a policy that\n\ndenies an insured the privilege of selecting a licensed psychologist\n\nshall, to the extent of the denial, be void, but such void provision\n\nshall not affect the validity of the other provisions of the policy.\n\nC. If any policy is issued by an insurer domiciled in this state\n\nfor delivery to a person residing in another state, and if the\n\nofficial having responsibility for the administration of the\n\ninsurance laws of such other state shall have advised the Insurance\n\nCommissioner that any such policy is not subject to approval or\n\ndisapproval by such official, the Insurance Commissioner may by\n\nruling require that such policy meet the standards set forth in\n\nsubsection A of this section and in Section 4405.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f0757232b29df9fb1004731c2d04da246dd9360b1d903cd02b36e12ab2bd9157","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-4403.1","next":"us-ok/okla.-stat.-tit.-36-36-4405"},"notice":"GroundRules: Original legal text.
