Stat. tit. 36, § 36-4419","heading":"Short-term, limited-duration insurance policies –","body":"Limitations on benefits provided.\n\nA. For the purposes of this section \"short-term, limited-\n\nduration insurance\" or \"STLDI\" means individual health insurance\n\ncoverage provided pursuant to a contract with an insurer that has an\n\nexpiration date specified in the contract that is less than twelve\n\n(12) months after the original effective date of the contract and,\n\ntaking into account renewals or extensions, has a duration of no\n\nlonger than thirty-six (36) months in total.\n\nB. An STLDI policy shall not be subject to the continuation\n\nprovisions of the Health Insurance Portability and Accountability\n\nAct of 1996, and shall be exempt from medical loss ratio\n\ncalculations associated with individual accident and health\n\ninsurance issued within this state.\n\nC. No STLDI policy shall be deemed to be included under the\n\ndefinition of group accident and health insurance issued or renewed\n\ninside or outside of this state and covering persons residing in\n\nthis state.\n\nD. The benefits provided by an STLDI policy may be limited as\n\nfollows:\n\n1. An STLDI policy shall not be required to contain one or more\n\nof the mandated accident and health insurance benefits otherwise\n\nrequired by Title 36 of the Oklahoma Statutes; and\n\n2. An STLDI policy shall include the definitions of individual\n\naccident and health insurance with respect to major medical benefits\n\nand standard provisions or rights of coverage.\n\nE. An applicant for an STLDI policy shall be provided, at the\n\ntime of application and in addition to any notice required by\n\napplicable federal law or regulation, a written notice that one or\n\nmore of the benefits mandated by Oklahoma law is not included in the\n\nSTLDI policy.\n\n1. The notice shall specify the essential health benefits that\n\nare included in the STLDI policy. For purposes of this subsection,\n\n\"essential health benefits\" means those benefits set forth in 42\n\nU.S.C., Section 18022(b).\n\n2. The notice shall specifically list the accident and health\n\ninsurance benefits otherwise required to be covered by Title 36 of\n\nthe Oklahoma Statutes that will not be covered.\n\n3. The insurer shall retain a signed copy of this notice on\n\nfile as a part of the original application as evidence that the\n\ninsured has acknowledged such notice.\n\n4. Such signed copy may be in original form, electronic file\n\nform or in any other reproducible file form as may be consistent\n\nwith the insurer's method of retaining application copies.\n\nF. An STLDI policy may offer various optional combinations of\n\ncoverage at additional premiums for each optional benefit offered.\n\nG. STLDI policies issued in Oklahoma shall be subject to the\n\nfiling requirements of Section 4402 of Title 36 of the Oklahoma\n\nStatutes.\n\nH.
