The Insurance Commissioner may adopt rules to implement the\n\nprovisions of the Long-Term Care Insurance Act. The Commissioner\n\nmay adopt rules that apply to all providers of long-term care\n\ninsurance coverage, whether or not a provider is otherwise subject\n\nto the provisions of the Insurance Code, and that include, but are\n\nnot limited to, standards for full and fair disclosure setting forth\n\nthe manner, content, and required disclosure for the sale of long-\n\nterm care insurance policies, terms of renewability, initial and\n\nsubsequent conditions of eligibility, nonduplication of coverage\n\nprovisions, coverage of dependents, preexisting conditions,\n\ntermination of insurance, continuation or conversion, probationary\n\nperiods, limitations, exceptions, reductions, elimination periods,\n\nrequirements for replacement, recurrent conditions, and definition\n\nof terms. The Commissioner may issue reasonable rules to establish\n\nminimum standards for marketing practices, agent compensation, agent\n\ntesting, penalties and reporting practices for long-term care\n\ninsurance.\n\nB. In addition to any other penalties provided by the laws of\n\nthis state, any insurer and any agent found to have violated any\n\nrequirement of this state relating to the regulation of long-term\n\ncare insurance or the marketing of such insurance shall be subject\n\nto a civil penalty of up to three (3) times the amount of any\n\ncommissions paid for each policy involved in the violation or up to\n\nTen Thousand Dollars ($10,000.00) whichever is greater.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"952a6c9c11c6fd7da9569ce33c803b05409ec0016241eb3100391a58bbcbf815","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-4426.2","next":"us-ok/okla.-stat.-tit.-36-36-4428"},"notice":"GroundRules: Original legal text.
