Upon approval of the Insurance Commissioner, an insurer may\n\ncharge an increased renewal premium upon showing that the increase\n\nis necessary because of utilization of policy benefits in excess of\n\nthe expected rate.\n\nB. 1. This section does not apply to life insurance policies or\n\nriders containing accelerated long-term care benefits.\n\n2. For certificates issued or delivered on or after November 1,\n\n1995, under a group long-term care insurance policy as defined in\n\nSection 4424 of this title, which policy was in force on November 1,\n\n1995, the provisions of this section shall not apply.\n\n3.
